County Planning staff to now review parcel creations prior to official recording
Beginning April 1, there will be an added layer of protection for anyone buying a parcel of land that has been subdivided, to ensure they can use the land as they intended. The St. Louis County Board today unanimously approved a resolution that requires the county's Planning and Community Development Department to review all parcel creations and splits prior to the Auditor's Office recording the change. This will apply to land in any part of the county where St. Louis County has zoning authority.
The extra review will protect land owners from possible mistakes that could block them from using the land in the way they wanted. It will also help prevent future boundary disputes and ensure land owners are compliant with various zoning regulations.
The Minnesota legislature last year approved a change in state statute, giving counties the authority - if they want it - to review deeds before the county Auditor transfers or divides the land or its next tax capacity in the official records. Cities already had this authority, but counties did not until the statute was amended in 2017.
The Planning and Community Development Department is responsible for regulating the subdivision of land anywhere in the county that is not within a city. County staff has already worked with real estate attorneys, surveyors, title companies and the county's planning commission to get input on the process and to ensure the best service. The department plans to review the process in a year to determine if any changes are needed.
