The MPCA has prepared a
new Part 70 general permit for facilities which have low actual emissions, high
potential emissions, and which have constructed and operated prior to getting
an air emissions permit. Without a permit to restrict the high potential emissions,
many of these facilities are considered to be major sources under New Source
Review (NSR) and National Emission Standards for Hazardous Air Pollutants
(NEHSAPs) programs, triggering federal regulations which require them to obtain
a Part 70 operating permit. The Low-Emitting General Permit fulfills this
requirement for these facilities, as well as providing a lower-cost alternative
to applying for an individual Part 70 permit. The target facilities for this
general permit are small businesses consisting mainly of spray-painting or
other coating operations and small combustion unit operations, including
auto-body shops.
Public Notice
The public notice for the general permit was published in the State
Register today, December 15, 2014. A copy of the Draft/Proposed General Permit
for Low-Emitting Facilities and Technical Support Document (TSD) is available
on the MCPA
website. Permit application forms and instructions, including eligibility
requirements, will be posted to the MPCA
website by mid-January 2015.
Low-Emitting Facility General Permit eligibility overview
1. Best Achievable Control Technology (BACT)-equivalent conditions. Facilities which are subject to the Injunctive Relief
provisions of NSR may choose to obtain this general permit instead of applying
for an individual Part 70 operating permit. Facilities which do so do not need
to prepare a BACT-equivalent analysis. The general permit contains BACT-equivalent
conditions which include:

Limiting the potential to emit (PTE) of PM, PM10,
PM2.5, and VOCs from material usage operations to 25 tpy or less;
-
Limiting the PTE of CO and NOx from combustion
operations to 25 tpy or less;
-
Limiting the PTE of single Hazardous Air Pollutants (HAPs)
to 5 tpy or less;
-
Limiting the PTE of total HAPs to 12.5 tpy or less;
-
Limiting allowable fuels to natural gas, liquid petroleum
gas, distillate oil (diesel, fuel oil #1 or #2), biodiesel, and/or gasoline
fuels. Sulfur content in distillate oil is limited to 15 ppm; and
-
Best Management Practices for coating applications,
abrasive blasting operations, and combustion sources.
2. 40 CFR pt. 60 New Source Performance Standards (NSPS). Facilities which are subject to the following NSPS are
