MPCA invites comments on statewide permit for burying concrete
Mankato, Minn. -- The Minnesota Pollution Control Agency (MPCA) invites comments through Sept. 11 on a statewide permit that would regulate burial of waste concrete. Under this permit, homeowners and others would be allowed to dispose of concrete by burying it on sites where the concrete originated, as long as they applied for coverage under this permit and certain conditions were met.
For volumes of concrete under 10,000 cubic yards, the conditions would include:
- The concrete is uncontaminated.
- The owner submits a complete permit application at least 10 days before disposal of the concrete.
- To be complete, the permit application must be signed by the local zoning authority.
For volumes of concrete 10,000 cubic yards and more, the conditions include:
- The concrete is uncontaminated.
- The owner submits a complete permit application at least 30 days before disposal of the concrete.
- To be complete, the permit application must be signed by the local zoning authority.
- The application must include documentation of why the concrete cannot be recycled.
The concrete eligible for on-site burial would include concrete block, slabs and forms, including incidental metal and other inert materials embedded in the concrete. The permit would exclude concrete washout or excess concrete that requires disposal at the time of construction.
“Uncontaminated” means the concrete has had no contact with petroleum products or hazardous substances.
Burial would be prohibited in places, such as floodplains, shoreland, wetlands, and wild and scenic areas.
The permit would not release the owner from complying with local laws or supersede local laws that prohibit such disposal.
