Request for Comments on Planned New Rules Governing PFAS in Products Reporting and PFAS in Products Fees

The Minnesota Pollution Control Agency (MPCA) published two Request for Comments (RFCs) on two planned PFAS rulemakings in the September 25, 2023, State Register. The two rulemakings are referred to as the PFAS in Products Reporting Rule (Revisor ID# R-4828) and the PFAS in Products Fees Rule (Revisor ID# R-4827). Each RFC includes instructions on how to comment. The public comment period for both RFCs closes at 4:30 p.m. on Tuesday, November 28, 2023.

The PFAS in Products Reporting Rules propose to establish a program for the MPCA to collect information about products containing intentionally added PFAS. Learn more here.  

The PFAS in Products Fees Rules propose to establish rule governing fees associated with required reporting of PFAS in products. Learn more here. 

The MPCA is implementing Amara’s Law, which is a new pollution prevention law that restricts the use of per- and polyfluoroalkyl substances (PFAS) in products sold and distributed in Minnesota. The timeline of Amara’s Law includes:

• January 2025: Ban on intentionally added PFAS in 11 product categories.
• January 2026: Manufacturers must report to MPCA on any use of intentionally added PFAS in their products.
• January 2032: Ban on intentionally added PFAS for all products, unless the MPCA determines they are a currently unavoidable use.

Implementation of Amara’s Law includes the development of new rules. Public comment is an important part of the rulemaking process.
