Minnesota's Electronic Recycling Act Update

June 30, 2012: Deadline for buying and selling pounds

Program year 5 ends June 30, 2012. Transactions between registered manufacturers and recyclers/collectors for pounds of recycled covered electronic devices (CED) must be completed before July 1, 2012.

Under Minnesota law, registered manufacturers, collectors and recyclers must make their own connections to buy and sell pounds of CED before the deadline. Recycling obligation for manufacturers is 80% by weight of VDD sales to Minnesota households.

Formal reporting by manufacturers of these transactions will be due to the Minnesota Department of Revenue on September 1, 2012.

July 15, 2012: Due date for collector and recycler reporting and registration

Reporting on PY5 (Program Year 5: July 1, 2011 – June 30, 2012) and registration for PY6 (Program Year 6: July 1, 2012 – June 30, 2013) is due July 15, 2012. Contacts for registered collectors/recyclers will receive an email with reporting and registration information when the PY5 reports are available on-line. Please carefully read the information below to prepare for successful reporting:

Collectors and recyclers need to keep track of how many pounds of MN household CEDs were collected and recycled from July 1, 2011 – June 30, 2012.
Collectors and recyclers need to report if the pounds collected are metro or non-metro. Metro pounds include Anoka, Carver, Chisago, Dakota, Hennepin, Isanti, Ramsey, Scott, Sherburne, Washington, and Wright.
Collectors and recyclers only need to report MN household pounds. Please ask this question when receiving MN CED’s. This currently does not include collection for refurbishment/reuse.
Collectors and recyclers need to report CEDs collected and recycled. The CED definition includes video display devices (VDDs). VDDs include TV’s, computer monitors, and laptops that are over nine inches. (see definitions below)
Collectors and recyclers must use registered collectors or recyclers. Please review the list of currently registered stakeholders on the MPCA e-waste web-site. Collectors and recyclers need to communicate with each other on how many pounds will be reported by all parties so reports match.
All MN household CEDs collected and recycled need to be reported, regardless if it will eventually be sold to manufacturers or not.
MN household CEDs need to be collected and recycled during the same program year.

Meeting specific requirements for reporting: If registration and reports are not completed by July 15, 2012, collector and recyclers will not be registered for the new program year (PY), pounds collected or recycled will not be eligible to be counted until reporting and registration are complete, and collectors and recyclers will be open to a possible enforcement action, which may include a monetary civil penalty. Forgivable APO’s were sent to collectors/recyclers for delinquent reporting/registration due July 15, 2011.

Household: An occupant of a single detached dwelling unit or a single unit of a multiple dwelling unit located in Minnesota who has used a video display device at a dwelling unit primarily for personal use.

Covered electronic devices: Computers, peripherals, facsimile machines, DVD players, video cassette recorders, and video display devices sold to a household by means of retail, wholesale, or electronic commerce.

Video display devices: Televisions, laptop computers, and computer monitors with displays larger than 9 inches (measured diagonally). "Televisions" include: TVs, TV-DVD/VCR combinations, monitors for home security/CCTV systems. "Computer monitors" include: monitors, all-in-one computers, laptop computers, eBook readers, digital picture frames, and portable DVD players.

Staples now collecting certain e-waste devices for free

Staples is another retail store that has joined the ranks of Best Buy in collecting certain e-waste devices at no charge, regardless of the brand or where it was purchased. A main difference between the programs is that Best Buy will accept TVs up to a certain size while Staples will not. Please review the websites to confirm what is and isn't accepted.

Please note that collectors with the MPCA e-waste program need to separately track Minnesota household CEDs for annual reporting.
