Welcome to the second edition of the ALL Together newsletter. The ALL Together newsletter provides updates, details, and information about assisted living licensure for providers, residents, family members, and the public.
The Minnesota Department of Health’s Health Regulation Division (HRD) will work to provide information, news, updates, and links to resources for assisted living providers and families to help residents and loved ones live their best lives as they age in place.

Save the Date - December ALL Teleconference
Save the Date for the next Assisted Living Licensure (ALL) Teleconference on December 9 from 10-11:30. The ALL webinar will feature updates from the Office of Ombudsman for Long-Term Care, food code updates and common survey findings from our partners in MDH’s Environmental Health Division, physical environment updates and common survey findings from our partners in MDH’s Engineering section, and other assisted living survey updates.

Reconsiderations and Appeals content added to the HRD Resources & Frequently Asked Questions website page. This information includes where reconsideration requests or appeals should be sent, and what items to include.
HRD posted a new survey form for Meal and Menu Requirements to help you prepare for your ALL survey.
Providers can use this tool to help them be compliant with Minn. Statute 144G.41 subd. 1(13)(i).
Take steps to prepare for a survey:

- Use the ALL Survey Forms to:
- Understand the requirements of assisted living statutes
- Conduct self-audits
- Be ready for an MDH survey
- Check out the ALL Resources and/or FAQ webpages for more information. HRD surveyors could show up at any point over the next two years. Prepare now to ensure your facility is providing proper care and services for your residents (per Minn. Statute 144G).
Each month we will highlight a portion of the Assisted Living License law (Minn. Statute 144G) that providers did not meet in recent surveys with resources to help you comply with the law.
Since Assisted Living Licensure was implemented on August 1, HRD has completed over 61 surveys with 483 tags issued to Assisted Living Facilities (ALF).
The Top 10 tags issued for ALF through October are listed below, these areas represents 37 percent of the tags issued.

Infection Control Program – Under Minn. Statute 144G.41 Subd. 3, 28 tags were issued.

Minnesota Food Code – Under Minnesota Staute 144G.41 Subd. 1, 20 tags were issued for not following the Minnesota Food Code, Ch. 4626.

Fire Protection and Physical environment – Under Minnesota Statute 144G.45 Subd. 2, 20 tags were issued

Resident grievances, reporting maltreatment – Under Minnesota Statute144G.41 Subd. 7, 19 tags were issued.

Disaster planning and emergency preparedness plan – Under Minnesota Statute 144G.42 Subd. 10, 16 tags were issued.

Contract required - Providing cares prior to contract – Under Minnesota Statute 144G.50, 16 tags were issued.

Initial reviews, assessments, and monitoring – Under Minnesota Statutes 144G.70, 16 tags were issued.

No proof of staffing logic/metrics, slow response time to call lights, staff sleeping – Under Minnesota Statutes 144G.41 Subd. 1, 15 tags were issued.

Posting information for reporting suspected crime and maltreatment – Under Minnesota Statute 144G.42 Subd. 7, 15 tags were issued.

Tuberculosis prevention and control – Under Minnesota Statue 144G.42 Subd. 9, 15 tags were issued.

An Assisted Living Director is required: Assisted Living Director (ALD) is a requirement for ALL facilities (Minnesota Statutes 144G.10 subd. 1a). AL facilities must employ an ALD. When HRD is out on survey and it is found that the licensee does not have an ALD, an immediate correction order will be written. Information on ALD/ALDIR can be found on the BELTSS website.

HRD Change of Information Form: HRD’s Change of Information form for Assisted Living Providers can be found here. Now included in this form is a section if a campus setting would like to close one of their buildings off of their license. See bottom of page 1. If residents are being moved as part of an internal transfer to another building within the same license number, providers need to make sure and follow the guidance in 144G.56 for a transfer of residents within a facility. Resident(s) moving to a different licensed address require providers to follow 144G.55 or 144G.57, as appropriate.

Voluntary Closure: If an assisted living facility elects to voluntarily close, the facility must notify MDH in writing by submitting the Assisted Living Licensure Closure Form (PDF) along with a proposed closure plan. Proposed closure plans are subject to the commissioner’s review and approval, and the facility may not take any action prior to the commissioner’s approval of the plan. Providers must ensure their closure plan includes all of the contents outlined in Minnesota Statutes 144G.57 and ALL Rules 4659.0130 subp 2.

ALFDC license needed for secure memory care: A provider who has a secure memory care unit must have an assisted living with dementia care license. A facility that is advertised, marketed, or otherwise promoted as providing specialized care for individuals with Alzheimer’s disease or other dementias must have an assisted living with dementia care license. If you realize you have the incorrect license type, please contact MDH immediately at health.assistedliving@state.mn.us.
