Public comment open for petitions to add qualifying medical condition, new delivery method for Medical Cannabis Program
Deadline to submit comments is Oct. 1
The Office of Medical Cannabis is accepting public written comment through Oct. 1, 2021, on petitions to add anxiety disorder as a new qualifying medical condition and gastrointestinal uptake infused edibles (GI edibles) as a new delivery method (the form in which a medication is taken) for Minnesota’s Medical Cannabis Program.
The petitions under consideration are:
The Minnesota Department of Health (MDH) accepts petitions from the public every year from June 1 through July 31. Additional petitions are no longer being accepted in 2021.

Background on the anxiety disorder petition
Since 2016, anxiety disorder or panic disorder has been petitioned to be added as a qualifying medical condition every year during the annual petition process.
Each past petition was denied due to lack of clinical evidence and the desire to avoid any unintended consequences.
At the conclusion of the 2020 petition cycle, Minnesota Health Commissioner Jan Malcolm requested the Office of Medical Cannabis take a more in-depth look at the issue, which included a review of the literature and research; interviewing states that have added or denied anxiety as a qualifying medical condition for their medical cannabis program; and convening a work group of professionals with expertise in anxiety disorder to obtain their perspectives. Following that, the Commissioner requested that the Office of Medical Cannabis submit a new petition for anxiety disorder as a qualifying medical condition.

Next steps
This fall, the Medical Cannabis Review Panel will provide the Commissioner of Health a written report identifying potential public health benefits and potential public health harms from adding or not adding anxiety disorder as a qualifying medical condition. The panel does not review petitions for delivery methods.
The Commissioner will approve or deny petitions (including the petition for GI edibles) by Dec. 1, 2021.
