Executive Order 21-21 will begin Friday, May 7, 2021 at 12 p.m. (noon) through May 27, 2021.
Effective May 7. All outdoor businesses will no longer be subject to occupancy limits. Outdoor businesses must follow requirements in the COVID-19 Universal Guidance for Outdoor Businesses and Entities (PDF) and continue to follow applicable industry guidance. Indoor businesses will change as outlined below.
Effective May 28, requirements for all businesses will be limited to the COVID-19 Universal Guidance for All Businesses and Entities – effective May 28, (PDF).
Effective July 1 or when the state reaches a 70% first dose vaccination rate (whichever occurs first), all COVID-19 requirements will end, including all face covering requirements. The Department of Health recommends individuals, organizations, businesses, and events continue to observe public health prevention and mitigation best practices and recommendations.
Key changes are in bold.
Restaurants, cafes, coffeehouses, bars, taverns, brewer taprooms, micro distiller cocktail rooms, farm wineries, craft wineries, cideries, golf courses and clubs, dining clubs, and other places of Public Accommodation that offer food and beverages are allowed to offer food for indoor and outdoor onsite consumption, within the following parameters:

Outdoor areas
- Follow the requirements in the Stay Safe Guidance for Restaurants and Bars and COVID-19 Universal Guidance for Outdoor Businesses and Entities on the Stay Safe Guidance for All Business Entities

Occupancy is no longer limited by COVID-related restrictions. State and local building, fire, and zoning codes continue to apply, and businesses are responsible for understanding local laws.
- Customers may stand while eating and drinking.
- Face coverings are required if the outdoor area has more than 500 people.
Indoor areas
- Establishments can be open for their normal business hours and no longer are required to close at 11:00 p.m.
- Capacity is limited to no more than 75% of established capacity, with no maximum cap. For venues with regular occupancy larger than 333, use the calculator to determine the reduced capacity.
- No more than ten customers may be seated together at any one time, including at the bar. Social distancing of 6 feet must be maintained between parties.
- Customers are required to wear face coverings, except when eating or drinking.
- Customers must be seated in all areas, except for when playing limited games outlined in the Stay Safe Guidance for Restaurants and Bars.
- Indoor private parties, events, receptions, or other gatherings in venues or separate spaces (i.e., ballroom or other private room) follow the capacity limits for indoor entertainment venues.
- Follow the requirements in the Universal Plan Guidance for COVID-19 Preparedness Plans found at Stay Safe Guidance for All Business Entities.

Entertainment venues include those that host outdoor and indoor wedding and funeral receptions, celebrations, and parties.
Outdoor entertainment venues

Occupancy at outdoor entertainment venues will no longer limited by COVID-related restrictions. State and local building, fire, and zoning codes continue to apply, and businesses are responsible for understanding local laws.
- Follow the Stay Safe Guidance for Entertainment and Meeting Venues and COVID-19 Universal Guidance for Outdoor Businesses and Entities on the Stay Safe Guidance for All Business Entities.
- Face coverings are required if the venue has more than 500 people. Additionally, face coverings are not required at outdoor events without a controlled perimeter, such as a parade or citywide fireworks display.
- Customers no longer must be seated while eating or drinking.
Indoor entertainment venues
- For venues with less than 500 occupant capacity, occupancy is limited to no more than 50%. No overall cap.

Groups of 10 may be seated together and do not need to maintain distanced from each other throughout the event or entertainment. Groups need to be distanced from other groups by at least 6 feet.

Seated venues with occupancy larger than 500, use the calculator to determine the reduced capacity. The venue may operate with an additional 25% occupancy above 50%.

Non-seated venues with capacity greater than 500, use the calculator to determine the reduced capacity. The venue may operate with an additional 15% occupancy above 50%.
- If there is no occupancy rating, take the square-footage of the venue accessible by patrons divide by 113. The square footage in the calculation should not include areas that are designated as employee only, no unauthorized access, are considered an inaccessible space, or are otherwise unavailable to patrons.
