Hemp-Derived Cannabinoid Product Compliance Fact Sheet Available

During the recent legislative session, authority for regulating sales of edible cannabinoid products, aka hemp-derived cannabinoid products (edibles, beverages, and topicals), was transferred from the Board of Pharmacy to the Minnesota Department of Health (MDH).

The new legislation requires all existing retailers register their establishment with the Minnesota Department of Health no later than October 1, 2023. The registration form will be available by August 1, 2023 and the link will be posted on the MDH Edible Cannabinoid Products webpage

The Minnesota Department of Health has begun conducting inspections of retail establishments that sell hemp-derived cannabinoid products. Retailers are encouraged to prepare for an inspection by ensuring they are compliant with the regulations. A fact sheet is available to guide retailers in assessing available product inventory and customer access. If you have questions, please contact the Minnesota Department of Health at health.hempedibles@state.mn.us

Additional information regarding product testing, packaging, labeling, marketing, advertising, and sales tax can be found on the MDH Edible Cannabinoid Products website. Check the website often for updates.
