Demuth raises concerns over missing forms for new Red Flag law, urges pause until all forms are made available
ST. PAUL — House Minority Leader Lisa Demuth, R-Cold Spring, issued the following statement on the incomplete rollout of the new Extreme Risk Protection order (ERPO) law, more commonly known as the Red Flag law. The new law went into effect on January 1st with the forms to file an ERPO being available on the Minnesota Judicial Branch website. However, the form to terminate an ERPO is still listed as “coming soon!” as of 12:30pm on Wednesday afternoon.
“Given the seriousness of infringing on Minnesotans’ Second and Fourth Amendment rights, especially when the respondent is not entitled to a trial or even a hearing under this new law, it is unacceptable that these forms are not fully available. They have had months to develop these forms and finalize the rollout—there is no reason this already constitutionally-dubious law should have taken effect without all the necessary forms.
“I have reached out to State Court Administrator Jeff Shorba requesting a timeline of when we can expect these forms to be available, and I am urging the Judicial Branch and the Walz Administration remove the ERPO petition from the website until the issue is resolved.”
