Due to recent updates to the Form FHWA-1273, “Required Contract Provisions Federal-Aid Construction Contracts (FHWA-1273)” by the Federal Highway Administration, all contractors working on Federal-aid highway construction projects must take steps to ensure continued compliance with federal regulations.
What must highway heavy contractors do to ensure compliance?
- Physically incorporate the revised FHWA-1273 into all subcontract and lower-tier subcontract templates.
- Physically incorporate the revised FHWA Form-1273 into any subcontracts or lower-tier subcontracts tied to Federal-aid construction contracts awarded by MnDOT or a local public agency post-October 23, 2023.
- Note: This requirement to use the revised FHWA-1273 does not apply to pre-existing contracts.
- Review and inform staff about the FHWA-1273 revisions.
