The Federal Highway Administration recently updated Form FHWA-1273, “Required Contract Provisions Federal-Aid Construction Contracts (FHWA-1273).” All contractors working on Federal-aid highway construction projects must take steps to ensure continued compliance with federal regulations.
What must highway heavy contractors do to ensure compliance?
- Physically incorporate the revised FHWA-1273 into all templates for subcontracts and lower-tier subcontracts.
- For all lettings on or after September 6, 2022, contractors must physically incorporate the revised July 2022 FHWA Form-1273 in all Federal-aid subcontracts and lower-tier subcontracts.
• The requirement to use the revised FHWA-1273 does not apply to pre-existing contracts.
- Review and inform staff about the FHWA-1273 revisions.
