The Federal Highway Administration and the Federal Transit Administration approved the goals proposed by the Minnesota Department of Transportation Office of Civil Rights for its Disadvantaged Business Enterprise program. The goals apply to contracts funded by the FHWA and the FTA. The annual goal is a percentage of the federal contracting dollars that are targeted for certified DBE firms to perform based on the availability of ready, willing, and able firms in Minnesota. MnDOT followed the recommendations of the Regents of the University of Minnesota, proposing an FHWA DBE goal of 12.6% and an FTA goal of 6.8%.
This goal will serve as an aspirational measure by which the Department will evaluate its DBE program performance, and the report conducted by Regents of the University of Minnesota provides a factual basis that offers a good foundation for this purpose.
MnDOT knows there have been many disruptions in the highway heavy construction industry because of the COVID-19 pandemic. As part of its DBE program administration, MnDOT will review its DBE program performance annually. In this review, MnDOT will consider market conditions, DBE firm capacity, active MnDOT projects, and other factors to determine whether an adjustment to the DBE goal is warranted. MnDOT can request a variance to its DBE goals, including a request to modify the goal if appropriate.
