Recent legislation makes changes to Functional Assessments


Recent legislation made changes to the Functional Assessment (FA) in Sec. 245I.10 MN Statutes, effective July 1, 2024. These changes impact Adult Mental Health Targeted Case Management (AMH-TCM); Adult Rehabilitative Mental Health Services (ARMHS); Assertive Community Treatment (ACT); Adult Day Treatment; Dialectical Behavior Therapy Intensive Outpatient Program (DBT-IOP); Intensive Rehabilitative Treatment Services (IRTS); Intensive Rehabilitative Mental Health Services (IRMHS) and Children’s Intensive Behavioral Health Services (CIBHS).

Changes include removing the requirement to use the CASII or ECSII as an assessment tool for children and youth under the age of 17, removing the narrative portion of the assessment, changing the requirement for the FA to be updated at least every 365 days (unless specified differently below) and allowing for the use of any validated measurement tool for adults, including the DLA-20.

The following will adhere to the requirements as in Sec. 245I.10 MN Statutes:

Intensive Residential Treatment Services (IRTS) will continue to follow the timelines in Sec. 245I.23 MN Statutes:

(g) Within 30 days of the client's admission, the license holder must complete a functional assessment of the client. Within 60 days after the client's admission, the license holder must update the client's functional assessment to include any changes in the client's functioning and symptoms. IRTS will otherwise follow the requirements in Sec. 245I.10 MN Statutes.

Intensive Rehabilitative Mental Health Services (IRMHS) will adhere to requirements in 245I.02, Subd. 17 Sec. 245I.02 MN Statutes.

Children’s Intensive Behavioral Health Services (CIBHS) will adhere to requirements found in 245I.02, Subd. 17 Sec. 245I.02 MN Statutes.

Children’s Mental Health Targeted Case Management (CMH-TCM) (state.mn.us) has no changes and is not impacted by the recent FA update.

Adult Mental Health Targeted Case Management (AMH-TCM) has no changes unless the assessment takes place as a TCM service in a Certified Community Behavioral Health Center (CCBHC) setting. If utilized in a CCBHC, use the requirements as noted in Sec. 245I.10 MN Statutes.
