Per Bulletin 22-68-16 Overview of 2022 Child Welfare Legislation local social service agency and professional staff are required to make every effort to have monthly visits with children outside the presence of their parents, foster parents, or facility staff. Situations in which a monthly caseworker visit may occur in the presence of child’s parents, foster parents, or facility staff must be documented in child’s case record and may include when:
- Child exhibits intense emotion or behavior indicating visiting without the presence of their parents, foster parent, or facility staff would be traumatic for them
- Despite caseworker's efforts, child declines to visit with them outside the presence of their parents, foster parent, or facility staff
- Child has a specific developmental delay, physical limitation, incapacity, medical device, or significant medical need, such that their parents, foster parent, or facility staff is required to be present with them during visits.
The Caseworker and Child Visits best practice guide has been updated to reflect these changes including how visits are documented in Social Service Information System. Caseworker and child visits best practice guide [Laws of Minnesota 2022, chapter 98, article 8, section 20]
