Family First Prevention Services Act News and Updates

ICPC requests are required when foster care children are placed out-of-state including placements in qualified residential treatment programs (QRTP’s).
Family First Prevention Services Act (FFPSA) and ICPC requires the following steps when making these types of placements.
- Determine if the facility selected for placement is a QRTP.
- Case worker contacts out-of-state provider to request status of the program.
- If the provider is unsure of their QRTP status, case worker contacts the state’s licensing authority to determine if facility is licensed/certified as a QRTP.
- If the case worker is unable to determine the status of the program after implementing previous two steps, the case worker can contact department staff at qualifiedindividual.DHS@state.mn.us for assistance.
- If the facility is a QRTP, case worker must request a qualified individual (QI) complete a QRTP assessment.
- To request a state QI contact qualifiedindividual.DHS@state.mn.us and department staff will work to assign a QI to complete a QRTP assessment.
- Once a QI has been assigned for a QRTP assessment, the case worker can start the ICPC process. Requirements for an ICPC request include the following:
- Complete and submit Form 100A DHS-4266-ENG located on DHS ICPC web page with accurate information regarding child and facility.
- Provide a copy of court order or voluntary placement agreement, establishing authority to place. The sending agency must have a signed court order establishing authority to place the child. If authority does not derive from a court order, a statement of the basis on which the sending agency has authority to place the child.
- Complete Financial/Medical Plan and indicate what the sending agency (Minnesota county) will provide for financial and medical support and include Title IV-E eligibility documentation. Medical coverage is expected to be arranged and confirmed between the sending agency and the residential facility prior to placement.
- Provide a copy of child’s out-of-home placement plan.
- Provide a copy of a letter of acceptance if required by receiving state. This letter identifies the specific out-of-state facility that will be providing care for a specific child. This letter also provides the receiving state ICPC office indication that the residential facility has screened the child as appropriate placement for their facility.
- Once the QRTP assessment is complete, case worker provides confirmation of completion to MN ICPC (icpc@state.mn.us). If placement in an out-of-state QRTP was determined NOT appropriate, please notify MN ICPC and withdraw the ICPC request.
