You are receiving this email because you are the authorized agent of a DHS-licensed Intensive Residential Treatment Services/Residential Crisis Stabilization (IRTS/RCS) program or DHS-certified mental health clinic or you attended a USS webinar.
The Minnesota Department of Human Services (DHS) Behavioral Health and Licensing Divisions are notifying you of a delay in the effective date of the Uniform Service Standards (USS) legislation passed in 2021. The effective date of the Mental Health Uniform Service Standards (Minnesota Statutes, chapter 245I) was either July 1, 2022, or upon federal approval of State Plan Amendments (SPAs) by the Centers for Medicare & Medicaid Services (CMS). We have experienced delays in submitting the required SPAs to CMS. We now anticipate an effective date of Sept. 15, 2022, and will notify you of the exact date when it becomes known.
All variances to licensing or certification requirements previously granted will now end the day before the new USS effective date. Many of the previous standard variances were incorporated into USS and are likely no longer necessary. If you still need a variance to the new requirements, please contact the licensor for your program or email dhs.mhcdlicensing@state.mn.us to discuss this possibility after August 15th.
For programs not yet licensed or certified, new applications will be available on the DHS-Licensing website in July 2022.
