Maltreatment reporting requirements

We have received several questions about maltreatment reporting requirements during Minnesota’s peacetime state of emergency and response to COVID-19. The Commissioner of Human Services has not waived or modified any reporting requirements contained in the Vulnerable Adults Act or the Maltreatment of Minors Act. All maltreatment reporting requirements remain in effect. However, during this time, we understand that the license holder’s first priority is the immediate health and safety of the individuals receiving services.
When reporting an incident, please include all reasonable efforts that were made to maintain compliance with rules and statutes, and if a deviation was necessary, an explanation as to why. These factors will be considered when assessing the incident and determining whether an out-of-office licensing or maltreatment investigation is necessary.
