Community Competency Restoration Taskforce September 25 Meeting

The Community Competency Restoration Taskforce is holding its third public meeting on September 25, 2019, 10:00 a.m. to 1:00 p.m. at the Department of Human Services Elmer A. Anderson building, 540 Cedar Street, St. Paul, MN 55101, Room 2380.

The Minnesota Department of Human Services established a legislatively mandated Community Competency Restoration Task force. This Task force was formed to evaluate and study community competency restoration programs and develop recommendations to address the needs of individuals deemed incompetent to stand trial.  The task force will meet monthly and all meeting are open to the public.  For more information, Please contact Mikki Maruska,  651-431-2178, or Michele.maruska@state.mn.us

Duties of the Task force

The Task force’s duties are described in Minnesota Laws 2019, 1st Special Session, Chap. 9, Art. 6, Section 77, Subd. 3, which established the Task force.  

Those duties include the following:

(1) Identify current service and resources available for individuals in the criminal justice system who have been found incompetent to stand trial;

(2) Analyze current trends of competency referrals by county and the impact of any diversion projects or stepping-up initiatives;

(3) Analyze selected case reviews and other data to identify risk levels of those individuals, service usage, housing status, and health insurance status prior to being jailed;

(4) Research how other states address this issue, including funding and structure of community competency restoration programs, and jail-based programs; and

(5) Develop recommendations to address the growing number of individuals deemed incompetent to stand trial including increasing prevention and diversion efforts, providing a timely process for reducing the amount of time individuals remain in the criminal justice system, determining how to provide and fund competency restoration services in the community, and defining the role of the counties and state in providing competency restoration.

 Deliverables for the Task force

The Task force shall submit a report on its progress and findings to the chairs and ranking minority members of the legislative committees with jurisdiction over mental health and corrections by Feb. 1, 2020 and a final report written report with recommendations is due February 1, 2021. Any draft legislation needed to implement the recommendations shall also be included.

Roles and Responsibilities

This Task force will identify current services and resources available for individuals in the criminal justice system who have been found incompetent to stand trial, will analyze current trends of competency referrals by county and the impact of any diversion projects or stepping-up initiatives upon those trends.

Meetings

The first meeting was held July 31, 2019 from 9:00 a.m. to 12:00 p.m. at the Department of Human Services, Elmer A. Anderson Building in Room 2370.

Each month through January 2020, the Taskforce will meet at the Anderson, the last Wednesday of each month, from 10:00 a.m. to 1:00 p.m. In November and December (November 20 and December 18) of 2019, the Taskforce will meet the second to last Wednesday of the month.
