Spectrum of Surrogate Decision Making for Adults with Decision Making Deficits:
What are the Options, and Who Has Authority to Do What?
August 23, 2018
Training via Video Conference from
Aging and Adult Services Division,
Community Supports for Seniors
Minnesota Department of Human Services
Presenter
Anita Raymond, LISW, CMC, Program Manager, Center for Excellence in Supported Decision Making, Volunteers of America – Minnesota
Description
Family members, agents, guardians, conservators, person served…who has authority to do what? It can be very confusing for providers working with people with compromised decisional capacity to decide where to turn when decisions need to be made; things may be further confounded when there are a number of formal and informal decision makers in existence. This session will describe decision making authority of common decision makers such as those appointed by a court (guardians/conservators) or through documents such as power of attorney, health care directives, as well as the role of family and persons designated as supporters by the person being served.
Target Audience Interested persons
Learning Objectives
Goal 1: List types, powers, and limitations of decision-makers and when decision-makers are needed
Goal 2: Understand statutory and practical aspects: when Guardianship/Conservatorship may be an effective option for a client and exploration of alternatives and why court intervention may not be the best option
Goal 3: Describe interaction, difference, and similarities between authority of guardian; health care agent, family member, attorney-in-fact, conservator
