Executive Order 20-39 Ensures Minnesotans’ Civil Rights are Protected during the COVID-19 Peacetime Emergency

On Wednesday, April 22, Governor Walz signed Executive Order 20-39 that aligns the Department’s charge-filing deadline with emergency legislation extending deadlines for filing civil suits in Minnesota courts. It also makes temporary and technical changes to the Minnesota Human Rights Act to ensure fairness for all parties involved in investigations.

Executive Order 20-39 specifically:

  • Extends the statute of limitations to file a charge of discrimination that would expire during the peacetime emergency until 60 days after it ends;
  • Allows the Department to accept a charge where the party signs a declaration under penalty of perjury, instead of requiring an in-person notary;
  • Allows charges, determinations, and dismissals to be served electronically, instead of by U.S. or certified mail, if the parties agree to electronic service;
  • Extends from 20 days to 60 days the time for a respondent to submit a written response to a charge; and
  • Extends from 10 days to 30 days the time allowed for parties to submit an appeal to the Department.
