Early Voting Grant Applications (Public Act 119 of 2023/House Bill 4437)

Reminder - BOE is Hiring

news update

The Fiscal Year 2024 budget includes a grant to provide funding for the implementation and execution of early voting as required under the Michigan Constitution and in accordance with Public Acts 81-88 of 2023. As required by the budget bill, funding will be “expended for incentive grants to counties to coordinate the implementation of early voting by local governments within their jurisdiction in the most efficient way possible.” Accordingly, the grants will be distributed to counties largely based on population and expected early voting turnout, so counties and locals must collaborate to ensure the grant application captures the needs of all jurisdictions in the county. Funding for early voting sites in a county may be capped at one site per two jurisdictions, absent good reason to deviate from that number.

Following a study of the equipment needed, the estimated cost of that equipment, the timeline for submitting orders, and taking into account responses from county clerks, the Bureau has created an early voting grant application, which was emailed to county clerks and election directors today. In order to be eligible for funding, county clerks must complete and submit the application, along with the countywide early voting plan, by September 8, 2023.  The Bureau has established a deadline earlier than the one provided by PA 81of 2023 to distribute funding as soon as possible to help clerks prepare for early voting.

Based on the materials requested in an application, the Michigan Department of State (MDOS) and BOE will determine the most efficient way to provide funding. The following methods of funding may be utilized depending on the situation:

  • The approved materials will be ordered by the county clerk or local clerk and billed to BOE (this method will likely be used for tabulators and VATs)
  • A grant amount will be approved for the county, specifying the approved materials; the county clerk or local clerk will purchase the approved materials; the county clerk will submit the reimbursement request to BOE; BOE will transmit the grant amount to the county clerk (this will likely be used for staffing support reimbursement)
  • The approved materials will be ordered through the BOE, similar to the drop box procurement (this will likely be used for early voting poll books)

A grant amount will be approved and transmitted to the county, specifying the approved materials, and the county will either pay for the approved materials using that grant amount or transmit it to the requesting municipality within the county to pay for the approved materials

Drop Box Procurement (Public Act 85 of 2023/House Bill 4697)

drop box

The Michigan Constitution and Public Act 85 of 2023 requires all jurisdictions to have at least one state-funded drop box for every 15,000 registered voters in the jurisdiction. BOE is required to facilitate the procurement and distribution of these drop boxes. Please note the following:

  • Every jurisdiction is entitled to at least one new state-funded drop box, even if one was provided in 2020.
  • The cost of delivery, installation, repair, and video monitoring for each state-funded drop box will be covered. Note: video monitoring does not include video data storage.
  • A jurisdiction with 15,001 registered voters must have at least two state-funded drop boxes; one with 30,001 must have at least three; etc.
  • Clerks are not precluded from installing more than the minimum number of drop boxes required, but additional boxes must comply with the requirements in Public Act 85 of 2023.
  • Clerks must ensure drop boxes are distributed equitably throughout the city or township (see News Update #2023-19 for more information).
  • Each clerk must ensure that their drop box information is entered into QVF so that an elector may use michigan.gov/vote to determine the location of each drop box in their city or township.

 In addition, drop boxes must:

  • Be affixed to the ground or another stationary object and designed to prevent removal of absent voter ballot applications and absent voter ballots.
  • Be clearly labeled as an absent voter ballot drop box that can be used to return completed absent voter ballot applications and voted absent voter ballots.
  • Be accessible 24 hours each day during the 40 days before Election Day, and accessible until 8 p.m. on Election Day.
  • Except for drop boxes ordered or installed prior to October 1, 2020, use video monitoring of drop boxes during the 75 days before each election.
  • Beginning January 1, 2026, all drop boxes must use video monitoring of drop boxes during the 75 days before each election.

Statewide contracts with 3 drop box vendors are in place, and the Bureau has been processing orders from clerks. Clerks may order their drop box(es) (that will be paid for by the state) by using this order form. Clerks may order one drop box per jurisdiction and an additional drop box for every 15,000 voters in their jurisdiction. The Bureau has also created a drop box web page where clerks can view the vendors and available drop boxes. Photos of the drop boxes are now also available on the web page. The Bureau is placing orders with the vendors at regular intervals and is prioritizing those from clerks with a November election. If you have a November election and have not yet ordered your drop box, please do so immediately. All others should place their order by the end of September.  Drop boxes will be delivered directly to the jurisdiction at an address provided by the clerk.

Additional Ordering Information

  • Please read the entire website before ordering. Important information regarding warranties and manufacturing lead times appears at the bottom of the page in “click to expand” vendor and product information sections.
  • LaserFab (aka Vote Armor) does not include graphics. BOE will send graphics to jurisdictions that order a LaserFab drop box and jurisdictions will have to apply the graphics themselves. Kingsley’s and American Security Cabinet’s boxes will come with graphics pre-applied.
  • Installation is not included in price. Clerks will need to arrange for a contractor or municipal maintenance staff to install their drop box(es). See installation videos. Installation costs will be reimbursable; clerks should retain proof of payment and receipts for services purchased.
  • Drop boxes will be shipped on pallets with cardboard shipping boxes. Be sure to check all the contents of the box to make sure all component parts have been retrieved before disposing of boxes. You may need a forklift, pallet jack, hand cart, dolly, etc., to move boxes after delivery. Delivery service will drop off at a dock or other location but is not required to move the box from the drop-off location. Pay attention to weights in the box description.
  • Jurisdictions can order additional boxes on their own directly with vendors and pay for boxes themselves at contract prices starting in Jan 2024.

Address Confidentiality Program Training Available in eLearning

In December 2020, Governor Whitmer signed the Address Confidentiality Program Act, Public Act 301 of 2020, MCL 780.851 et seq. The Address Confidentiality Program (ACP) was created to provide certain protections for victims of domestic violence, sexual assault, stalking, human trafficking, or those who fear that disclosure of their physical address will increase the risk of harm. Information on how the program works and how to enroll are available on the Address Confidentiality Program website. The program is scheduled to launch at the end of August. For general questions about the program, you can email AG-ACP@michigan.gov

Because participants’ voter registration (residential address) is protected, ACP also impacts the way participants receive election mail and appear in QVF and electronic pollbooks. The Bureau has created the Address Confidentiality Program training module to help clerks understand how to conduct voter registration and ballot issuance tasks in the Qualified Voter File (QVF) along with accompanying best practices for mailing and record keeping responsibilities for ACP participants.

Automatic Voter Registration Update

This month, MDOS is integrating automatic voter registration (AVR) into additional driver’s license transactions. The process for clerks will not change, but voter registration status updates will occur earlier and with more frequency for some driver’s license holders.

Currently, automatic voter registration is included in mail transactions for driver’s license renewals and changes of address. In addition to these transactions, AVR will now be included in mail transactions when a driver’s license holder advances to Graduated Driver’s License (GDL) Level 2 or 3, or when a GDL holder progresses to operator’s license status. As with other mail AVR transactions, voters will receive a notice that they will be automatically registered to vote unless they opt out.  This notice will provide the individual with 30 days from the date the letter was issued to opt out of AVR. The customer can opt out by mailing the letter to Bureau of Elections (BOE) or through online services.  If the customer does not opt out within the 30-day timeframe they will be registered to vote.

Customers must meet the following criteria to receive the AVR letter:

  • At least 17 years and 6 months old.
  • Marked as a U.S. Citizen in the driver database (CARS).
  • Not currently registered to vote.
