Edw. C. Levy Company: public comment on draft enforcement action

The Michigan Department of Environment, Great Lakes, and Energy (EGLE), Air Quality Division (AQD), is asking for comments from the public on a proposed Consent Order for Edw. C. Levy Company (Levy). We will accept comments until the close of the comment period on October 25, 2024.
Engaging with the public on enforcement actions is important. There are two opportunities to learn about air quality enforcement and the draft Levy consent order. More information on attending these meetings is below. We hope these help the public learn more about this enforcement action and participate in the public comment process. At the end of the public comment period, we will review all comments before we make a final decision.
Background:
The enforcement action against Levy addresses fallout violations at the Plant 6 Facility in Detroit and odor violations at the Section 2 Facility. A draft consent order is a legal agreement, containing a monetary fine, a compliance plan, additional fines if similar future violations occur, and a "Supplemental Environmental Project” (SEP). A SEP is an environmentally beneficial project that alleged violator agrees to undertake as part of a settlement. It is voluntary and not required by state or federal law.
