Update of LUST Site Classification Policy and Procedure
The Leaking Underground Storage Tank (LUST) Site Classification System Policy and Procedure (RRD-21) has been revised. The Michigan Department of Environment, Great Lakes, and Energy, Remediation and Redevelopment Division (RRD) is updating all former policies. Section 21314a of Part 213, Leaking Underground Storage Tanks, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA), requires LUST sites to be classified consistent with the process outlined in ASTM Standard Guide for Risk Based Corrective Action at Petroleum Sites (E 1739-95).
The major revision to the LUST classification system is to move from Classes 1 to 4 to Classes 1 to 5. This allows for the state funded actions at LUST sites that address all current long-term risks to be tracked as Class 4, and the approved LUST Closure Report to be tracked as Class 5. This also allows the Inventory of Facilities in the Remediation Information Data Exchange (RIDE) database system to use the same risk classifications for sites regulated by Part 213 and Part 201, Environmental Remediation, of the NREPA.
Generally, no significant changes were made regarding the classification of risk in Class 1 through 3, however additional clarification to appropriately classify the LUST release was added. The LUST Site Classification Form (EQP4469) that is part of the revised Policy and Procedure was developed to assist in classifying LUST sites consistently and accurately by working through the form. The completed form is required to be submitted with all LUST reports pursuant to Part 213.
