Acute Vapor Hazards Related to a Release From An Underground Storage Tank System
The Department of Environmental, Great Lakes, and Energy, Remediation and Redevelopment Division (RRD) has updated the 2013 Guidance Document for the Vapor Intrusion Pathway (2013 VI Guidance) to promote a consistent and informed approach to identify and, if necessary, mitigate acute vapor hazards upon confirmation of a release from an underground storage tank system regulated under Part 213, Leaking Underground Storage Tanks, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, specifically Section 21307. This Addendum provides information to RRD staff, RRD contractors, and persons required to address releases under Part 213 regarding the identification, investigation, and evaluation that RRD will find acceptable to satisfy the requirements to identify an acute vapor hazard consistent with Section 21307.
RRD developed the 2013 VI Guidance document to provide information to department staff and their contractors conducting investigations and remedial or corrective actions at sites with potential volatilization to indoor air issues. Updates to this document are provided when items arise that need additional clarification.
The Addendum is explanatory, it does not establish or affect the legal rights or obligations for complying with Section 21307. It does not have the force or effect of law and is not legally binding on the public or the regulated community. Any regulatory decisions made by the department regarding Section 21307 will be made by applying the governing statute and associated administrative criteria rules to relevant facts.
