Marathon order for fines and community project complete

The Michigan Department of Environment, Great Lakes, and Energy’s Air Quality Division has made important changes based on public comment as it finalized a Consent Order for Marathon Petroleum Company, LP. Marathon will pay a fine, improve the air handling and filtration system at the Mark Twain School for Scholars, and create a public website that will share real-time air quality information as part of the order.
The projects included in the order include the two community or Supplemental Environmental Projects (SEPs). SEPs are voluntary and must go above and beyond what is required by law and provide added benefits to the community or environment.
Based on comments from the community, changes were made to the final order. These changes include:
- Requirement of proof of benefits for each SEP and how those benefits were measured.
- Change from the originally proposed air purification equipment to a system called “Needlepoint Bipolar Ionization”, which is certified ozone-free.
- Additions of descriptions and information about:
- The filter changeouts in the air system.
- How the two different filters work together.
- When the filters will be changed.
- Adjusted the amount of money Marathon will spend on the SEPs because the projects were evaluated further after they were proposed.
- Clarified reporting requirements for both projects including quarterly, semi-annual, and annual reports.
- The air handling and filtration project at Mark Twain School will be ready to use by August 31, 2021. The real-time air quality website will be ready 30 days from the date the order was signed. In addition to the changes to the order listed above, the order also:
- Addresses alleged air quality violations.
- Requires Marathon to follow a compliance program.
- Includes addition fines for future violations of the finalized order.
- Requires Marathon to pay a total of $363,853, including:
- A $81,853 fine, due within 30 days.
- At least $282,000 to be paid toward the SEPs
