EGLE Announces Two PFAS Cleanup Criteria Development Information Sessions
The Michigan Department of Environment, Great Lakes, and Energy (EGLE) promulgated state drinking water standards for per- and polyfluoroalkyl substances (PFAS) effective August 3, 2020, that do not have cleanup criteria established under Part 201, Environmental Remediation, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (Part 201). State drinking water standards are also commonly referenced as maximum contaminant levels and developed under section 5 of the State Drinking Water Act, 1976 PA 299 [MCL 325.1005].

EGLE must follow the process set forth by statute and rule to establish cleanup criteria because there are no cleanup criteria currently for these substances. The process to establish cleanup criteria will be initiated with two informational meetings. The initial informational meeting will present the statutory and rule process that must be followed to establish any generic cleanup criteria when there are no current criteria. The second informational meeting will be a follow up to present the results of the first part of the process to calculate generic cleanup criteria for groundwater used as drinking water for PFNA, PFHxS, PFHxA, PFBS, and HFPO-DA (also known as GenX). There will be a three week public comment period after the second informational meeting to allow interested parties to submit written comments regarding whether the process for establishing the criteria followed the regulations under Part 201. EGLE will review and consider the comments prior to publishing and promulgating enforceable groundwater cleanup criteria for these substances.

Again, this second session is not a repeat of information from the first session but a presentation to present the results of the calculations.
