Public comment period open for US Steel Great Lakes Works Air Quality Enforcement

The Michigan Department of Environment, Great Lakes, and Energy (EGLE), Air Quality Division (AQD) has opened a public comment period on a proposed Consent Order for US Steel Great Lakes Works (US Steel). The public comment period will remain open until July 13, 2020. Two opportunities have been scheduled to get information, ask questions of AQD staff and provide comment at an informational session on May 28, 2020 and an informational session and hearing on June 24, 2020.

AQD has issued several violation notices to US Steel alleging the company violated state and federal rules and regulations and violated requirements in its existing air permit. US Steel is legally obligated to return to compliance after a violation is issued. Due to the number of violations, the AQD has taken an enforcement action. To settle the action, the AQD and US Steel agreed to enter into a proposed Consent Order.

The purpose of the public comment period and public hearing are to allow all interested parties the opportunity to comment on the proposed Consent Order, in accordance with Governor Gretchen Whitmer and the Michigan Department of Health and Human Services’ recommendations designed to help slow the spread of Coronavirus Disease 2019 (COVID-19).

The public is encouraged to review information and present comments on the proposed Consent Order at any time before the end of the comment period. Key documents are available in Arabic and Spanish. There are several ways to submit comments for this proposed permit.

All statements received during the public comment period will be considered by the decision-maker prior to a final decision being made on the proposed Consent Order. Once all comments are considered, the decision-maker will decide whether to enter into the proposed Consent Order as written or renegotiate the terms with US Steel based on the comments received.
