The MDEQ, Remediation and Redevelopment Division, is extending the public comment period for the proposed Part 201 Cleanup Criteria Requirements for Response Activity rules to Wednesday, February 7, 2018. 

The proposed rules will amend the current rules to revise the generic cleanup criteria, which are also the risk-based screening levels for regulated substances under Part 213.

This proposed comprehensive Cleanup Criteria Rules package was revised based on continued discussions with stakeholders and comments received during the previous public comment periods. These changes are of sufficient significance to warrant additional public review and comment.

The proposed rules document, with the newest revisions highlighted in yellow, is available on the DEQ’s Generic Cleanup Criteria Web page. A comparison of the proposed cleanup criteria rules with the 2013 rules is included with the latest iteration. The MDEQ has also prepared a preliminary version of the response to comments received, and it is also available to assist in explanation of the revisions. The Cleanup Criteria and Screening Levels Development and Application background document (June 2016) for the criteria and screening levels is also available, but has not yet been updated for the most recent revisions.

The proposed rules (2015-094 EQ) are officially published on the Office of Regulatory Reinvention’s website at www.michigan.gov/orr. Click on “Latest Rules Activity” and then “Pending Rule Changes.” Under “Rules by Department,” click on “Environmental Quality.” Scroll to ORR 2015-094 EQ and click on “Revision Text.” The rules are also published in the December 15, 2017 issue of the Michigan Register.
