Coastal Notes

 

The Michigan Coastal Zone Management Program (MCZMP), in the Office of the Great Lakes, Michigan Department of Environmental Quality (MDEQ), was approved by the National Oceanic and Atmospheric Administration (NOAA) in 1978, pursuant to Section 306 of the Federal Coastal Zone Management Act of 1972 (P.L. 109-58). The MCZMP, as approved, includes enforceable policies involving the management and protection of the Great Lakes coastal zone in Michigan that are contained in several State statutes and administrative rules. To keep the MCZMP current, it is occasionally necessary to update the description of those enforceable policies to reflect legislative amendments, rule revisions, and similar actions.

 

Federal Regulations (15 CFR 923.84) require that such changes to an approved State Coastal Management Program be submitted to the Federal Office for Coastal Management (OCM), NOAA, as Routine Program Changes (RPC). The MDEQ is submitting the following as RPCs of the MCZMP:

 

Repeal of the Shorelands Protection and Management Act, 1970 Public Act 245, and subsequent codification as Part 323, (Shorelands Protection and Management), of the Natural Resources and Environmental Protection Act, 1994 Public Act 451, as amended. These changes constitute minor refinements in the State law addressing protection and management of the lands and waters in close proximity to the shoreline of Michigan’s Great Lakes and connecting waterways. The changes maintain a high level of resource protection.

 

The State considers the submission to constitute RPCs and has requested OCM’s concurrence in that determination. Any person wishing to comment on whether or not the action does or does not constitute RPCs of the MCZMP may do so by sending written comments to Ms. Joelle Gore, Chief, Stewardship Division, NOAA Office for Coastal Management, N/OCM6, 1305 East-West Highway, SSMC 4, Room 10622, Silver Spring, Maryland, 20910, or Joelle.Gore@noaa.gov. Comments must be sent within three weeks of the date of publication of this notice.
