USDA Final Interim Rule for Industrial Hemp Available for Public Comment

On October 29, 2019, the United States Department of Agriculture (USDA) released its draft rules outlining their provisions needed to approve state industrial hemp production plans. 

USDA’s Final Interim Rule for Industrial Hemp remains subject to change pending completion of the public comment process. The Final Interim Rule will be posted on the federal register for review and comment and will be in effect initially for two years while final rules are developed. The Michigan Department of Agriculture and Rural Development (MDARD) is reviewing the draft rule and will likely provide remarks during the comment period.

MDARD will continue its Industrial Hemp Ag Pilot program into 2020. With the release of the USDA Final Interim Rule, MDARD will work state legislators to update Michigan’s hemp law to be in line with federal requirements. MDARD will submit its state plan for USDA review and approval once the updates to state law have been made.
