Update Maine’s 1115 Substance Use Disorder (SUD) Demonstration Waiver
On December 22, 2020, the Centers for Medicare and Medicaid Services (CMS) and the Office of MaineCare Services (OMS) announced CMS’s approval of Maine’s 1115 Demonstration Waiver allowing Maine to expand access to substance use disorder treatment by increasing the bed capacity limit for Section 97, Appendix B Private Non-Medical Institution (PNMI) SUD treatment facilities. Under the waiver, states can waive the long-standing federal "Institutions for Mental Disease (IMD) Exclusion," which prohibits the use of federal Medicaid funds for care provided to adult patients in mental health and SUD residential treatment facilities larger than 16 beds. The details of Maine’s 1115 SUD Demonstration Waiver application are available online. Please note that Maine’s approved waiver is only for SUD, and not mental health residential treatment facilities. At this time, we are working with CMS to meet requirements so that we may begin to operationalize the demonstration.
MaineCare is currently configuring MIHMS to allow Appendix B provider types to have an IMD specialty. Once this system change is complete, providers wishing to expand capacity beyond 16 beds as allowed by this waiver will need to update their MaineCare provider enrollment through a maintenance case on the Health PAS Online Portal. We will notify providers when they may be able to update their provider enrollment to reflect this.
Interested providers will also need to submit a Substance Abuse Agency License Application and Change Form to the Division of Licensing and Certification. An additional inspection from the State Fire Marshal’s Office may be necessary in order for a provider to receive approval on this application. We will provide more information on the status of this demonstration waiver as it is available and will be hosting a virtual information forum for providers in early February to further discuss details of the waiver. Effective December 31, 2020, codes 92585 and 92586 have been end dated. Effective January 1, 2021, these codes are replaced with the codes in the table below.

Please resubmit denied claims that have been submitted with end dated codes for dates of service after January 1, 2021 with the codes listed above. If you billed with the new codes before the system was updated, you may now resubmit these claims.

How to Clear Cookies on Your Computer to Help Fix Issues
When you use an internet browser, it saves some information from websites in its cache and cookies. Clearing cookies and cache fixes certain problems, like loading or formatting issues on sites. If you experience such issues on the Health PAS Online Portal, use the directions below to clear cookies on your computer.
Google Chrome:
- Open Chrome.
- At the top right, click ellipsis. It looks like three dots.
- Click “More tools” and then “Clear browsing data.”
- At the top, choose a time range. To delete everything, select “All time.”
- Check the boxes next to “Cookies and other site data” and “Cached images and files.”
- Click “Clear data.”
Internet Explorer:
- Open Internet Explorer.
- Click the settings button in the top right of the window.
- Click “More tools” and then “Clear browsing data…”
- Ensure the checkbox for “Cookies and other site data” is checked.
- Click “Clear data.”
Firefox:
- Open Firefox.
- In the upper right-hand corner of the browser, click the ellipsis. It looks like three dots. Click the “Privacy” tab.
- Select “Clear your recent history.”
- Be sure that only “Cookies” is checked and then select the time frame for which you would like to delete your cookies. If you want to delete all cookies, select “Everything.”
- Click “Clear now.”
