WAIVER: Section 19, ME.0267, Elderly and Adults with Disabilities Waiver
CONCISE SUMMARY:
The Department is planning to amend the Elderly and Adults with Disabilities Waiver, known in Maine as Section 19, Home and Community Benefits for the Elderly and Adults with Disabilities. This waiver amendment implements legislation passed by the Maine Legislature through P.L. 2019, ch. 102, which requires the Department to submit a waiver amendment to Centers for Medicare and Medicaid Services (CMS) to allow eligible MaineCare members (served under this waiver ME.0276) to receive services provided by spouses who are employed as personal support specialists. As a result, this amendment proposes to make changes to Appendix C-2-d to allow spouses to provide extraordinary care (as defined by CMS) for Personal Care services.
Additionally, the amendment proposes to remove Behavior Regulations Training as a requirement for Assistive Technology in Appendix C-1/C-3.This change will be effective upon approval of this amendment by CMS.
DHHS is accepting comments from November 15, 2019 through December 15, 2019.
