RE: Weaver Wind Project; Osborn, T22 MD BPP, and T16 MD BPP; Site Law Certification

On November 9, 2018, the Land Use Planning Commission accepted a Request for Certification submitted by the Maine Department of Environmental Protection, as complete for processing. Specifically, the Request asks the Commission to determine if the Weaver Wind Project (a) is an allowed use within the subdistricts in which it is proposed, and; (b) meets the land use standards established by the LUPC that are not considered in the Department of Environmental Protection’s (DEP) permit review for the project.

The Weaver Wind Project includes the construction of 22 wind turbines, installation
of permanent and temporary met towers, installation of an electrical transmission line, expansion of an existing substation, construction of new access roads, and improving
existing access roads. A portion of the Project is located in the Town of Eastbrook; how-
ever, a majority of the Project is located within unorganized or deorganized areas of the State. The subdistricts affected by the Project are the General Management (M-GN), Shoreland Protection (P-SL), and Wetland Protection (P-WL) subdistricts.

On November 26, 2018, the Commission determined that the Project is an allowed use
within the subdistricts in which it is proposed, because the proposal is a wind energy development and it falls entirely within the expedited permitting area for wind energy development, as established by the Legislature in 2008 (PL 2007, Ch. 661). Currently, the Commission is reviewing the proposal to determine if it meets the applicable land use standards.

Additional information may be requested of Weaver Wind, LLC by the Commission during
the review process. A copy of the Public Notice, the Request for Certification, and the Commission’s Certification of Allowed Use have been posted on the Commission’s website (https://www.maine.gov/dacf/lupc/projects/site_law_certification/slc_links.shtml).
