NOTICE OF PUBLIC HEARING AND OPPORTUNITY TO INTERVENE

On October 10, 2018, the Maine Land Use Planning Commission (the Commission)
authorized a public hearing on the allowed use on Brookfield White Pine Hydro, LLC’s
(Brookfield) application for Hydropower Permit HP 30. The Commission is providing notice
of the public hearing and opportunity to intervene in accordance with Chapters 4 and 5
of the Commission’s rules.

PURPOSE: The Maine Land Use Planning Commission will hold a public hearing and seek public comment regarding Brookfield White Pine Hydro, LLC’s (150 Main Street, Lewiston,
ME 04240) application for a permit pursuant to 38 M.R.S. § 633(1) and Administrative Regulations for Hydropower Projects, 01-672 C.M.R. 11 (Chapter 11), section 2(B). Brook-field proposes to reconstruct Middle Dam located on Lower Richardson Lake in Township C. Middle Dam is part of the Upper and Middle Dams Storage Project regulated by the Federal Energy Regulatory Commission (FERC) license P-11834-ME. The project is referred to as the Middle Dam Renewal Project.

The purpose of the hearing is to allow Brookfield and members of the public the opportunity
to present testimony and evidence as to whether the Middle Dam Renewal Project meets the applicable review standards in 38 M.R.S. § 636 and Chapter 11, section 5.

TIME AND PLACE: Notice of the hearing date and location, once set, will be published in a newspaper of general circulation in the Lower Richardson Lake region, on the Commission’s website at: https://www.maine.gov/dacf/lupc/projects/hp_30_middle_dam_renewal/hp30.

HOW TO PARTICIPATE: All interested persons are invited to attend and offer testimony relevant to the approval criteria and standards for reconstruction of a hydropower project. The public is not required to submit written testimony before the hearing, nor file Petitions
to Intervene, in order to testify. Members of the public may simply attend the hearing and give oral testimony. A written comment period will follow the hearing.

PETITIONS TO INTERVENE: Persons interested in seeking Intervenor status in this matter must file a Petition to Intervene with the Commission pursuant to Chapter 5, Section 5.13 of the Commission’s rules by 5:00 P.M. on November 9, 2018. The public is not required to file Petitions to Intervene in order to testify.

Closing dates for the hearing record will be established in a subsequent procedural order.
