Polystyrene (EPS) Food Service Products Ban Deadline Extended

Westminster, Maryland (June 15, 2020) – The Carroll County Health Department and Carroll County Government announce that the Maryland Department of the Environment has extended part of the Polystyrene (EPS) Food Service Products Ban deadline as a result of the current state of emergency.

The original date for the ban to go into effect was July 1, 2020; the new date for the full ban to begin will be October 1, 2020 or 30 days after the State of Emergency is terminated, whichever is earlier. The extension does NOT apply to the sale of EPS food service products under § 9-2203(a) of the Environment Article, which continues to take effect July 1, 2020.

When the full law goes into effect, a food service business or school may not sell or provide food or beverages in an EPS foodservice product. Food service businesses and schools may continue to use existing inventories of EPS food service products (e.g., cups, plates, bowls, trays, etc.) until October 1, 2020, but will not be able to purchase additional EPS food service products after July 1, 2020, as the partial ban will be in effect.

If you have any questions about the Polystyrene (EPS) Food Service Products Ban, please visit the Maryland Department of the Environment EPS Ban page, or contact Cheryl Chaney, Community Hygiene Program Manager, cheryl.chaney@maryland.gov or 410-876-4878.
