Council Overrides Mayor Fischer's Landmarks Veto

By a vote of 18 to 7, I and a majority of the Louisville Metro Council voted to override the Mayor’s Veto of the recently passed landmarks ordinance at last night's Council Meeting. The ordinance, which was passed in an effort to include more community involvement and notification before a structure is designated as a landmark will become law, and marks the first time since the establishment of merged government that the council has taken such action.

The ordinance represents more than six months of discussion and debate, which included multiple public hearings throughout various parts of the community. The ordinance was sponsored by myself and a bi-partisan group of 12 other members of the Metro Council and focused on adding oversight to a Landmarks Commission that even the Mayor recognized was not perfect and led to serious questions by people in different parts of the community. Despite the manner in which the Mayor and others have attempted to portray it, this ordinance does not eliminate the Landmarks Commission, nor does it eliminate the ordinance which helps to protect historic properties. This ordinance was created simply to ensure that the Council has the ability to challenge the commission, because as the mayor stated in his veto letter, “the Commission sometimes oversteps its boundaries at the cost of the public good.”

The following are additional highlights of the Landmarks Ordinance:
  • Gives the option for a voluntary pre-application meeting of all interested parties, owners and landmarks commission.
  • Require that 101 of the 200 petitioners live or own property within a combination of a one mile radius and/or the council district where the property is located.
  • Requires that more residents surrounding a proposed property have to be notified of the process.
  • Extends the time before a public meeting has to be held so that the Landmarks Commission has time to do their work.
  • Allows the Metro Council the ability to bring up the issue after the Landmarks Commission has acted but only if a majority of the council votes to do so.

In addition to overturning the Mayor’s Veto, the Metro Council also unanimously voted to adopt the recommendations that were part of a Southeast Metro Regional Center Study and an ordinance that asks restaurants that provide caloric and other dietary information on their web-sites to provide that same information within their establishment.
