The Louisville Metro Air Pollution Control District (District) proposes to issue a construction permit to Outer Loop Recycling & Disposal Facility (operates a municipal solid waste landfill), 2673 Outer Loop Road, in accordance with Regulation 2.03. The 30-day public comment period starts on August 24, 2024, and ends on September 23, 2024. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

Ormsby Avenue, Suite 303, Louisville, between 8:00 a.m. and 5:00 p.m., Monday through Friday, by calling Matt King at (502) 574-6000, emailing airpermits@louisvilleky.gov, or at the following website: http://www.louisvilleky.gov/APCD/docket. Copies of the application are available upon request. Written comments will be accepted at airpermits@louisvilleky.gov until midnight or at the District office until 5:00 p.m. on September 23, 2024.

What is the purpose of this permit? Construction Permit C-0532-24-0022-V would permit the source to install an additional flare to process off-specification gas at the Waste Management Renewable Energy High BTU Gas Plant.

Will this permit increase pollution? Because new Flare #5 will process the gas that was processed by Flare #3, the only increase in emissions will result from the combustion of natural gas for the Flare #5 pilot light. The highest pollutant of concern will be nitrogen oxides, at 0.022 tons per year.

Does this facility have a history of non-compliance? The last notice of violation was in 2014 and was resolved with an agreed board order. See the Compliance History table in the Statement of Basis, page 6.
