Feds Warn Employers Against Disability Discrimination

Increasingly common methods that employers are using to select new hires, judge performance and determine pay or promotions may discriminate against people with disabilities, federal officials say.

The U.S. Department of Justice and the Equal Employment Opportunity Commission say artificial intelligence and other software tools used by companies can result in employers violating the rights of people with disabilities under the Americans with Disabilities Act. Businesses frequently use computer-based tests or resume-scoring software to screen job applicants as well as other technology to assess the performance of current and prospective workers.

In guidance issued late last week, the agencies point out that without safeguards, software tools can screen out capable people with disabilities. For example, a wheelchair user interviewing for a cashier position may be turned away by a chatbot if they say they cannot stand for hours even though they could do the job while seated, the EEOC notes.

The guidance stops short of telling employers that they cannot use artificial intelligence and other software tools, instead detailing what steps should be taken to ensure ADA compliance.

When utilizing technological tools, employers should consider the impact on people with various disabilities and have a process for providing reasonable accommodations when appropriate, the guidance indicates. Employers should also remember that if software tools make people disclose information about their disabilities or medical conditions, that could lead to inquiries or medical exams that are not permitted.

“Algorithmic tools should not stand as a barrier for people with disabilities seeking access to jobs,” said Kristen Clarke, assistant attorney general for civil rights at the Justice Department. “This guidance will help the public understand how an employer’s use of such tools may violate the Americans with Disabilities Act, so that people with disabilities know their rights and employers can take action to avoid discrimination.”

Beyond guidance for employers, the EEOC is also offering tips for people with disabilities who believe they have been discriminated against.

“New technologies should not become new ways to discriminate,” said EEOC Chair Charlotte A. Burrows. “If employers are aware of the ways AI and other technologies can discriminate against persons with disabilities, they can take steps to prevent it.”

This represents an unprecedented opportunity to strengthen and expand the existing network of over 200 locally operated and funded crisis centers across the country.

In advance of the 988 transition in July, the Lifeline Suicide & Crisis Network is looking to bring on new volunteers and paid employees to answer calls, chats, and texts from people in crisis. ACL is announcing a new funding opportunity entitled “Strengthening the Direct Care Workforce (DCW): A Technical Assistance and Capacity Building Initiative.” With approximately $1.3 million per year from a combination of the Older Americans Act, Rehabilitation Act, and the Developmental Disabilities Assistance and Bill of Rights Act program funding, this five-year project will result in the establishment of a new National Technical Assistance Center designed to strengthen the direct care workforce that provides home and community-based services (HCBS) to people with disabilities and older adults. This new initiative will become a central hub for state, private, and federal entities involved in the hiring, recruitment, training, and workforce development associated with the delivery of HCBS. This initiative builds off and will advance the collaboration between ACL, the Department of Labor, and other HHS agencies, including the Centers for Medicare and Medicaid Services (CMS) and the Assistant Secretary for Planning and Evaluation.   The current shortage and frequent turnover of direct care workers not only compromises the ability of older adults and people with disabilities to live in the community, but it also compromises their health and safety. The need for DCWs is projected to grow significantly in the next decade as the number of older adults increases and more people with disabilities live in the community instead of in institutional settings. The recruitment, retention, and development of a competent workforce is critical to providing HCBS so that older adults and people with disabilities can live, work, and participate in the community. Focusing on strategies and practices at the systems and provider levels and with information dissemination and direct technical assistance as a key component of the project, the grantee will partner with a broad range of stakeholders and subject matter experts to broaden our national understanding of the challenges associated with the DCW while supporting cross-systems collaborations to strengthen it. The TA Center will offer access to a curated array of model policies, best practices, training materials, technical assistance, and learning collaboratives.

Things you should know about planning your life celebration

Plan your life celebration in advance.  Even if it is a long way off.  When a future event is important, like going to college, or having a wedding, we plan it in advance.  Planning your own life celebration is no different. 

Nobody should have to try and plan for a loss at the same time they are experiencing one.

Have the conversation    Prearranging is the best way for families to take it slow and talk about things in a calm, compassionate environment away from the stress that often occurs at the time of sadness and loss.  Many people think they have taken care of everything by writing a will, establishing a living will or purchasing cemetery property, there are many more details to consider. 

Understand the difference between prepaying and pre planning -  Planning your life celebration in advance (pre-planning), can ensure all of the details will be taken care of, but only funding your plan ahead of time (pre-paying), locks in today’s pricing.  Along with the cost of living, funeral prices continue to rise.  Paying in advance provides opportunities for discounts and payment plans to fit your needs.

Final expense insurance may not be enough - Life insurance, as well as final expense insurance, provides a one-time, lump-sum benefit.  However, there is no guarantee that those funds will not have already been consumed by expenses from a long illness or serious accident.  Like everything else, prices of products and services will continue to rise, but the amount of your policy coverage will remain the same. 

A prepaid funeral or cremation service can help with Medicaid assistance -  In many states, a prearranged funeral or cremation may be treated as an exempt asset for Medicaid qualification purposes.  This allows you to pre arrange the service you desire while maintaining your assistance eligibility.
