Ordinance to Increase the Insurance Premium Fees Passed by Metro Council Budget Committee Now Goes to Full Council

The Ordinance will now go to the next full Metro Council meeting on March 21 for a final vote.  The following Metro Council Members are on the Budget Committee and this was the vote on this ordinance:

 AN ORDINANCE AMENDING LOUISVILLE METRO CODE OF ORDINANCES CHAPTER 122 TO INCREASE THE INSURANCE PREMIUM FEES.

SPONSORED BY: COUNCIL PRESIDENT JAMES AND COUNCILMEMBERS SEXTON SMITH, HOLLANDER, MULVIHILL, AND WINKLER

WHEREAS, the Commonwealth has left us with the unenviable position of having a 50 million dollar pension obligation in our annual budget to be paid over the next several years due to mismanagement and poor investment of our pension system; and

WHEREAS, Louisville/Jefferson County Metro Government (“Metro”) cannot absorb this extraordinary expense without looking at new revenue or cutting existing services; and

WHEREAS, Metro wants to continue to provide services to its residents without sacrificing the quality and quantity of such services from police and fire protection to emergency services to road paving and infrastructure repair and improvements, community centers, libraries, affordable housing and parks and the services provided in conjunction with our other government and nongovernment partners; and

WHEREAS, in order to keep the momentum and economic renaissance we have built in Louisville and ensure we meet the needs of our residents, Metro is forced to take the unprecedented position to raise revenue, which has not been done since Merger and, in fact, no new taxes or rates have been increased since 1982 when the Old City of Louisville increased the insurance premium tax from 2.5% to 5% and in 1990 when Jefferson County raised the insurance premium tax; and

WHEREAS, Metro cannot continue essential governmental operations with this pension obligation being handed down to us by the Commonwealth; and

WHEREAS, Metro wants to ensure that residents still are getting what they need and deserve and do not want residents to forego the services upon which they have come to depend; and

WHEREAS, while Metro will continue to consider other revenue options, we believe that an increase in the insurance premium tax is the most viable option for Metro to continue with the same level of services; and

WHEREAS, the increase in funds generated by the increase in the insurance premium tax is sought for the express purpose of addressing Metro’s pension obligations, health insurance costs, or unforeseen emergencies.

NOW THEREFORE BE IT ORDAINED BY THE LEGISLATIVE COUNCIL OF THE LOUISVILLE/JEFFERSON COUNTY METRO GOVERNMENT AS FOLLOWS:

SECTION I: LMCO § 122.02 is hereby amended as follows:

FEE FOR COMPANIES ISSUING LIFE INSURANCE POLICIES.

The license fee imposed upon each insurance company which issues life insurance policies upon the lives of persons residing within Louisville Metro shall be based upon 5% of the first year's premium and applied to the amount of such premiums actually collected within each calendar quarter by reason of the issuance of such policies. For the period of July 1, 2019 through June 30, 2021 the license fee shall be 12.5%; for the period of July 1, 2021 through June 30, 2022 the license fee shall be 13.5%; and thereafter the license fee shall be 15%.

SECTION II: a new section of LMCO is hereby created and designated as LMCO § 122.04:

FEE FOR COMPANIES ISSUING INSURANCE POLICIES FOR MOTOR VEHICLES 3

The license fee imposed upon each insurance company which issues motor vehicles insurance policies for persons residing or entities located within Louisville Metro shall be based upon 5% of the premium and applied to the amount of such premiums actually collected within each calendar quarter by reason of the issuance of such policies.

SECTION III: LMCO § 122.03 is hereby modified as follows and renumbered as LMCO § 122.05:

FEE FOR COMPANIES ISSUING POLICIES OTHER THAN LIFE, HEALTH, OR MOTOR VEHICLE INSURANCE.

(A) The license fee imposed upon each insurance company which issues any insurance policy which is not a life, or health, or motor vehicle insurance policy shall be 5% of the premiums actually collected within each calendar quarter by reason of the issuance of such policies on risks located within Louisville Metro on those classes of business which such company is authorized to transact, less all premiums returned to policyholders. For the period of July 1, 2019 through June 30, 2021 the license fee shall be 12.5%; for the period of July 1, 2021 through June 30, 2022 the license fee shall be 13.5%; and thereafter the license fee shall be 15%. The provisions of this section shall not include premiums received for insuring employers against liability for personal injuries to their employees, or the death of their employees, caused thereby, under the provisions of the Workers' Compensation Act or premiums from policies of health insurance.

(B) No license fee imposed under this section shall apply to premiums paid to insurers of municipal bonds, leases, or other debt instruments issued by or on behalf of the Louisville Metro Government or other political subdivision of the Commonwealth. However, the exemption shall not apply if the bonds, leases, or other debt instruments are issued for profit or on behalf of for-profit or private organizations.

SECTION IV: Sections LMCO §§ 122.04, 122.05, 122.06, 122.07, and 122.08 are hereby renumbered as LMCO §§ 122.05, 122.06, 122.07, 122.08, and 122.09, respectively.

SECTION V: This Ordinance becomes law upon its passage and approval and becomes effective by July 1, 2019.

The annual program that helps prevent low income residents of Louisville from being disconnected from utility services began on Monday. LIHEAP, the Low Income Home Energy Assistance Program, is administered by Louisville Metro Office of Resilience and Community Services. The Crisis Component of LIHEAP will run through March 29, or until available funds have been expended, whichever comes first. This year’s Crisis Program once again features expanded eligibility allowing residents who received a utility bill with a past due amount to apply, in addition to continuing to serve those who received a disconnect notice. Residents wishing to apply must make an appointment in advance utilizing the automated appointment system. The toll free service is available twenty four hours a day, seven days a week. Appointments can be scheduled by phone by calling 502-991-8391 or online at louisvilleky.cascheduler.com. Addiction Recovery Services Available through Volunteers of America

Volunteers of America have recently opened new addiction recovery locations to better serve the community. They have several programs at 1436 South Shelby Street. Freedom House is a residential program for pregnant and parenting women. Shelby Men’s Recovery Center is also located on South Shelby. This is a 90 day residential program for men, where clients are able to work while seeking treatment. They have Intensive Outpatient Programs (IOP) and services for men, women and families. These services are available at 2500 West Broadway and 4303 W Broadway. Transitional Housing will be available in July for homeless women with children who would like to continue their sobriety at 4303 W Broadway If you are know someone who may be interested in VOA’s programs, please contact the intake office at 502-635-4530. They’re able to do a quick screening, verify their insurance, and set up an intake date and time.

Mary M. Miller Riverboat Cruise Rescheduled - April 14

The rescheduled Mary M. Miller riverboat cruise is coming up soon!  Due to dangerous weather conditions, the original date was cancelled and moved to Sunday, April 14th in order to give enough time for water levels to return to normal. There will be two cruise departure times, 1:00pm and 4:30pm. Boarding will begin 30 minutes prior to each of these scheduled times. Limited seating will be available the day of the cruises. Louisville Grows - Seeds & Starts Sale at Greenhouse April 20 & May 11

Get your garden started with low-cost plant starts from Louisville Grows’ Seeds and Starts Sale. This yearly plant sale helps community members grow and eat fresh produce from their backyards and community gardens.  Proceeds from the sale directly support Louisville Grows’ Community Garden Grant program. At the Seeds and Starts Sale, you are able to purchase plants for your yard or community garden plots for a lower price than you’ll find in local stores.  Each spring, we use volunteer help to grow thousands of organic plants in our greenhouse to sell at-cost to the community. We offer a wide variety of heirloom and organic vegetables, flowers, fruit trees, berry bushes, soil, compost, and more. Sign up for Free Trees thru Community Canopy Program

TreesLouisville, a nonprofit organization focused on replenishing the urban tree canopy in Louisville. We are partnering with the Arbor Day Foundation for a program called Community Canopy to provide free trees for residents of Louisville. 

• TreesLouisville is partnering with the Arbor Day Foundation to provide 870 free canopy trees to Louisville residents. Louisville loses around 54,000 trees yearly and this is one way we can help replenish our depleted canopy.
• Residents of Louisville can go to arborday.org/treeslouisville to participate. The program will have them provide an address, outline their home, and choose a tree from a selection of bald cypress, sugar maple, sycamore, tuliptree, blackgum, or swamp white oak. The program will recommend a location to plant the tree to maximize energy savings.
• After making their selection, participants will either have their tree shipped directly to their home or can pick up their selection Saturday March 9 from 11am-6pm or Sunday March 10 from 11am-5pm at Fresh Start Growers Supply: 1007 E. Jefferson St. Louisville, KY 40206.

MSD Bowl Patrol Only Flush the 3 P's

MSD’s recently unveiled “Bowl Patrol” campaign features a friendly cast of characters that are spreading the message to only flush “the three Ps—pee, poo and toilet paper. The campaign uses humor to convey how to avoid a serious spotty foul, which can result in unnecessary expense for home and business owners, as well as MSD. 

That damage is costly. because wipes don’t break down, they clog machinery and build up in wet wells. Dental floss, underwear, feminine hygiene products don’t break down and, once they are in the system, it doesn’t take much for them to cause damage.  They have to get cutters and go in and cut these items into little pieces to get them free from machinery.

People who are interested in fostering will need to fill out the Foster Application(PDF) and either email, fax to 502-473-2634, or bring the completed application to the LMAS Animal Care Center, located at 3705 Manslick Rd. Feeding Stray Cats?  Alley Cat Advocates can help get outdoor cats fixed and vaccinated at NO COST TO YOU!    Cat Caretakers living in the following Jefferson County zip codes 40208, 40209, 40213, 40214, 40215, 40216, 40217, 40219, 40258 and 40272 are eligible  for spay/neuter services for unowned community cats,  They will be vaccinated, spayed/neutered, treated for flea and ear-mite medicine, given a great vet visit, ear-tipped (the universal symbol of a neutered cat) and returned. When there are no more kittens; the number of cats gradually goes down  and annoying behaviors such as yowling, fighting, spraying stop.
