NOTICE OF CHANGE IN NOTIFICATION PROCESS UPON CLAIM FILING WITH THE DWC

For all Applications for Resolution of Claim filed on or after June 16, 2018, the Department of Workers’ Claims will first issue a document titled “LMS ACCESS CODE NOTIFICATION,” the purpose of which is to provide all parties the LMS access code assigned to that claim in order to allow the parties to associate to the claim for the purpose of filing pleadings.

          The Department of Workers’ Claims will subsequently issue a document titled “NOTICE OF FILING OF APPLICATION” pursuant to 803 KAR 25:010 Section (2) (a).  This document will constitute notice that a claim has been filed for the purposes of filing a Notice of Claim Denial or Acceptance (Form 111) and Notice of Disclosure; assign the claim to an ALJ; schedule the date, time and location of the Benefit Review Conference; establish the schedule for proof-taking; and state the week during which a hearing is to be held.
