Legislative Updates
During the 2024 Legislative Session, House Bill 2745 was adopted which exempts spouses of active military servicemembers who reside or plan to reside in Kansas due to the assigned military station of the individual’s spouse from all occupational licensing, registration, and certification fees.
Effective July 1, 2024, eligible individuals as defined by the bill will be exempt from all original application and license fees, Kansas Bureau of Investigation (KBI) background check fees, and renewal application fees. The applicant or licensee is responsible for indicating eligibility for the exemption each time an application form is completed and could be subject to discipline if eligibility is misrepresented pursuant to K.S.A. 58-3062(f)(1).
The bill requires KREC to implement rules and regulations to implement these provisions. Any changes will be reflected in the Kansas Real Estate Commission Statute Book once revised regulations are adopted.
Cease and Desist Authority and Unlicensed Activity
Effective July 1, 2024, the Commission has authority to issue cease and desist orders to act against unlicensed individuals. Per amendments to K.S.A. 58-3065, if the Commission determines that a person or associated association, corporation, limited liability company, limited liability partnership, partnership, professional corporation, or trust has practiced without a valid real estate license issued by the Commission, in addition to any other penalties imposed by law, the commission, in accordance with the Kansas administrative procedure act, may issue a cease and desist order against the unlicensed person.

In the world of real estate, we are taught to disclose what we know. But if you are working as a transaction broker in a residential real estate transaction, there are certain things you cannot disclose without the consent of the buyer and seller. This includes:
- A buyer or tenant will pay more than the purchase price or lease rate offered for the property.
- A seller or landlord will accept less than the asking price or lease rate for the property.
- The motivating factors for any party buying, selling, or leasing the property.
- A seller, buyer, landlord or tenant will agree to financing terms other than those offered.
- Information or personal confidences about a party to the transaction which might place the other party at an advantage unless the disclosure is required by law or failure to disclose such information would constitute fraudulent misrepresentation.
For example, you are a transaction broker working with the buyer and the seller is represented by an agent from a different real estate office. You find out the seller is selling their property due to an upcoming divorce filing. In this situation, you cannot tell your buyer about the seller’s motivation for selling because that would put the buyer at an advantage over the seller in the transaction.
Real estate licensees need to be conscious of their brokerage relationship in each transaction to ensure they are not providing information that is prohibited. When in doubt, talk to your supervising broker.
