This is the second in a series of quarterly updates for school coordinators approved to teach real estate in Kansas. School coordinators and instructors should subscribe to receive important news from the Kansas Real Estate Commission related to educational requirements.
Weekend Expiration Reminder
This weekend, the first of the month falls on a Saturday. As a reminder, CE credit must be conveyed via FTP to KREC within five calendar days of course completion or by the licensee’s expiration date, whichever is sooner.
If you have a student with an expiration date of July 1, CE credit must be submitted accurately and received by KREC no later than midnight of the expiration date to avoid a violation.
CE Submission Refresher
Below are the most common violations of the CE reporting requirements:
- CE must be submitted to KREC within five calendar days of the course completion date, not business days.
- If a licensee’s expiration date falls before the five-day window, the school must submit the information no later than midnight of the licensee’s expiration date.
- It is the responsibility of the school to report an accurate name and license number for each student. Verify licensee information here.
Outdated Regulations Found in Courses
Several regulations have changed since 2019. We still see outdated information floating around when auditing courses, so be sure to update what you are sharing with students. The Commission will always post a regulation change in the monthly Commission Newsletter. If you aren’t currently subscribed, do so here and avoid missing important information. Below is an overview of what has changed.
Effective August 22, 2022:

K.A.R. 86-1-5. The amendments removed the fee in regulation to change the affiliation of a Kansas real estate license, clarifies language related to fees for submission of applicant fingerprints to the KBI and increases the fee for submitting an individual education course approval request from $10 to $20 per course.
Effective April 23, 2021:

K.A.R. 86-3-10.The amendments clarify requirements for records to be retained by Kansas licensed brokers.

K.A.R. 86-3-18.The amendments clarify requirements for trust account records and include a section related to closing a trust account previously in K.A.R. 86-3-21.

K.A.R. 86-3-21.Revoked due to obsolete language related to documentation requirements and a subsection being moved to K.A.R. 86-3-18 for consistency.

K.A.R. 86-3-22. The amendments simplify transaction identification numbering procedures related to broker records. Instead of requiring numbering based on contract date, the broker can assign any number if it is unique to the transaction.
Effective July 1, 2020:

K.A.R. 86-1-11. Repeal requirement for “broker core” course. The Kansas Required Core replaces the “salesperson/broker core.” Allow for three hours of elective CE credit during a renewal period to be earned by attending a Commission meeting.

K.A.R. 86-3-7. Affiliated licensees are prohibited from including in an advertisement a name or team name which: Uses the terms “realty,” “brokerage,” “company,” or other terms that can be construed as a separate real estate company from their supervising broker’s company; is more than 2x greater in font size than the supervising broker’s business name in the advertisement; and is not adjacent to the supervising broker’s trade name or business name in any digital advertisement.
Effective July 1, 2019:

K.S.A. 58-3039. Reduce the look back period for broker experience from five years to three years immediately preceding the date of a broker application.

K.S.A. 58-3045. Eliminate the $50 late fee for licenses renewed after the renewal date, but before the license expiration date and increase the late fee to $100 for a license renewed after the expiration date, but before the six-month grace period ends. Eliminate the renewal date deadline. Renewal is due by the license expiration date.

K.S.A. 58-3046a. Increase the current broker pre-license education course from 24 hours to 30 hours and rename the course the “Kansas Real Estate Fundamentals Course.” Add a new 30-hour broker pre-license course titled “Kansas Real Estate Management Course,” required for new broker’s license applicants.
Effective January 1, 2019:

K.A.R. 86-1-3. For new licenses, the license expiration date will be the first day of the month of issuance two years after the date of issuance. Any license issued prior to Jan. 1, 2019 will keep the same expiration date currently in effect unless the license type is changed or the license lapses and application for a new license must be made.

K.A.R. 86-1-5. The fee for submission of a broker application increased to $50.The fee to open an office increased to $100.

K.A.R. 86-3-15. The requirements for reporting litigation and criminal charges were modified.

Compliance Courses - Courses on Broker Supervision and BRRETA are offered by the Commission and assigned to licensees as discipline, however many educators attend voluntarily for the information. Details and registration information are available here.
