Are You Operating a Branch Office?
Cindy Boswell | Real Estate Specialist/Investigator
Growing your real estate business can be exciting. As a licensee’s business grows, the licensee may want to have their own professional office space. Before conducting real estate activities and putting a sign in the window, you may want to ensure you are operating within the law.
A branch office is defined as a place of business other than the principal place of business of a broker. The following must be done for a licensee to regularly conduct business at a location other than their broker’s business location or to advertise a location as their office:
- Approval from the supervising broker
- Designation of a branch broker to supervise the branch office
- Registration of the branch office with KREC
Per advertising requirements, K.S.A. 58-3086(a)(3), no licensee shall include an office where real estate activity is conducted that is not designated as a primary or branch office with the Commission.
K.S.A. 58-3060(b) also states, “A supervising broker shall be designated to supervise the primary office and the activities of salespersons and associate brokers assigned to the primary office. Each additional office or place of business shall be designated a branch office and a branch broker shall be designated to supervise such office and the activities of the salespersons and associate brokers assigned to such office.”
A licensee should discuss with their supervising broker the need for a branch office before opening an office space outside of the supervising broker’s primary office.
Continuing Education Basics
Jennifer Box | Senior Administrative Specialist
When it comes to continuing education (CE), there are a few basics you should know. First, check out our new Education FAQ section for all-things education. Secondly, KREC provides several resources about CE on our website, such as a directory of approved providers and courses. Any courses listed on this directory are approved for CE credit by the Commission. You must contact the education provider directly to enroll in these courses. KREC does not coordinate enrollment for any CE courses.
The provider will submit CE credit directly to the Commission after successful completion of the course. Providers have up to five calendar days to submit credit (or by the license expiration date, whichever is sooner). You do not need to submit your completion certificates, unless requested by KREC staff.
To meet the CE requirements, you must complete at least nine hours of electives and three mandatory hours in a course titled “Kansas Required Core” every two years. Credit cannot be substituted for the required course. We recommend completing CE well in advance of your license expiration date to prevent delays in renewal.
Lastly, did you know you can complete CE at any time during your two-year renewal cycle? You do not have to wait until your renewal period (45 days prior to your expiration date) to complete CE hours. View CE hours for your current cycle by logging into MyLicense E-Gov. You may also view your license expiration date, update contact information, make affiliation changes, submit your renewal application, and pay renewal fees through this account. Once your renewal is submitted, your CE hours will reset to zero for the new renewal cycle. You cannot view CE hours for previous renewal cycles on this account. We recommend saving your completion certificates for your personal records to review later if needed.
Allow yourself plenty of time to complete the necessary requirements and resolve any issues prior to your license expiration date. Explore the multiple resources available at krec.ks.gov to help make your CE completion and license renewal experience go as smooth as possible.
Commissioner Celebration
Recently, the Commission honored Joe Vaught and Sue Wenger who served on the Commission from 2013-2021. The Commission also honored Errol Wuertz, who served from 2011-2022, and Connie O’Brien, who served from 2016-2021, for their service but were unable to attend the ceremony. Thank you, Commissioners!
