Do You Have Knowledge of Adverse Material Facts?

KREC often receives questions related to property inspection reports. Listing agents ask if they must provide new buyers a copy of inspection reports that were paid for by a previous buyer.
License law does not require a copy of the report to be provided to the buyer, however, the licensee (whether acting as a seller’s agent or transaction broker) has the obligation to disclose any adverse material facts actually known by the licensee. If the licensee knew of issues noted in the inspection reports, the licensee must disclose the adverse material facts to the buyer. The previous buyer may have paid for the report but if the listing agent has knowledge of any adverse material facts the listing agent MUST disclose those facts.
K.S.A. 58-30,106(d)(1) states that a seller’s or landlord’s agent owes no duty or obligation to a customer, except that a licensee shall disclose to any customer all adverse material facts actually known by the licensee.
K.S.A. 58-30,113(b)(2)(F) states that a transaction broker shall exercise reasonable skill and care as a transaction broker, including disclosing to all prospective buyers or tenants all adverse material facts actually known by the transaction broker.
In addition, if a seller’s agent or transaction broker has knowledge of any facts that were omitted from or contradict any information in a written report, they are required to disclose that information to the customer or client. New Commission Member
Marsha McConnell was appointed in April 2022 to serve as the 1st Congressional District representative to the Commission.
Marsha was raised in Greensburg and is a graduate of Fort Hays State University. She is a long-time resident of Hutchinson, and she and her husband have two grown children and two grandchildren. Her first career was as a Registered Nurse in critical care areas for over 18 years before changing careers in 2000 and becoming a full-time REALTOR®. She is actively involved at the local, state, and national levels. Marsha has served as a local Board President two times, served as the President of the Kansas Association of REALTORS® in 2020, and continues serving on local, state, and national committees. She is looking forward to working with the professionals at the Kansas Real Estate Commission.

Reporting CE Credit to KREC
Approved education providers in Kansas have up to five calendar days to report completed continuing education (CE) credit to KREC. If a licensee’s expiration date is before the five-day period, the provider must submit CE credit no later than the expiration date. However, licensees should not wait until the last minute to complete CE since conveyance of CE credit is not always automatic. Plan accordingly and complete CE early to help avoid frustrating situations. Licensees may complete CE any time during their current two-year renewal cycle.
Licensees should not send course completion certificates to KREC and ask for credit to be applied to their account immediately following the end of a course. This certificate is for the licensee’s records only and does not need to be sent to KREC unless requested by KREC staff. Licensees should login at E-Gov to check CE credit on file. If credit is missing, start by reaching out to the education provider for assistance.

Employee Spotlight
Aleksa Kent is a licensing specialist at KREC since July 2021. She reviews and processes licensing applications and renewals. She is currently in school to obtain a degree in Business Management. Aleksa has two girls and is also raising her little brother. She enjoys long walks on the beach…just kidding, sand is hard to walk on. Aleksa recently discovered she has a green thumb and has accumulated over 30 plants in the last six months. She loves learning new things, reading, photography, and grounding herself in nature.
