Who Can be a Designated Agent?

Many real estate licensees in Kansas practice designated agency. It is important to remember that designating an agent affects both the licensee and the supervising broker.
A salesperson, branch broker, or associate broker may be a designated agent for the seller or buyer by being specifically named as such in the agency agreement. This automatically makes the supervising broker a transaction broker.
The supervising broker of a main office cannot be a designated agent. The only options for the supervising broker are: (1) seller agent, (2) buyer agent, or (3) transaction broker. If a supervising broker is a seller agent or buyer agent all licensees in the brokerage act in the same capacity as the supervising broker.
Check with your supervising broker before filling out the designated agent information on an agency agreement and help prevent brokerage relationship conflicts for the brokerage. See K.S.A. 86-3-26a.
Award-Winning Compliance Course
We are excited to announce the Broker Supervision compliance course was awarded during the Award-Winning Ideas session at the 2021 ARELLO® Annual Conference in Orlando! ARELLO® brings regulators together to promote excellence in real estate regulation.
The Broker Supervision compliance course focuses on principal areas of broker responsibility, effectively managing an office and supervising affiliated licensees, common violations, advertising, and mitigating and aggravating factors. A broker license is required to attend this course.
Compliance courses are taught by Wendy Alkire, Deputy Directory, Director of Compliance, and assigned by the Commission as discipline. Many educators and licensees attend voluntarily for the information. CE credit is not provided.

Employee Spotlight
Amber Nutt is the Director of Education and Communication at KREC. Amber supervises and administers all functions of the education department. She reviews course applications, monitors courses and schools for compliance, and assists in conducting school meetings and other commission-produced education courses. Amber also implements agency communication and outreach efforts by producing the Commission Newsletter, creating instructional materials, and managing social media content.
She has worked in adult education, educational technology, and research for 15 years. She holds a bachelor’s and master’s degree from the University of Kansas. Amber lives in the Kansas City area with her husband, two children, one old dog, and two hamsters. She loves any reason to be outside.
