2023 Air Emissions Reporting Requirements
This letter is a reminder regarding the annual emissions inventory reporting requirements for your facility(s). This letter is provided electronically using account information from SLEIS and KEIMS; A physical copy of this letter is NOT being sent to facilities.
Our records indicate that one or more of your facilities is currently required to operate under a Class I or Class II operating permit. Per Kansas Administrative Regulations (K.A.R.) each facility that is required to operate under a Class I or Class II operating permit must submit an annual emissions inventory. Facilities that are subject to a Class I operating permit must also submit an annual emissions fee pursuant to K.A.R. 28-19-517. The reporting requirements, and fee if applicable, for the preceding calendar year of 2023 must be submitted to the department by Monday, April 1, 2024.
Note: Annual emission fees will change for the 2024 reporting year with the annual report due in 2025. These changes are approved with the latest version of K.A.R. 28-19-517, K.A.R. 28-19-546, and K.A.R. 28-19-564. For Class I facilities, fees will be the sum of $1000 plus $80 per ton of Hazardous Air Pollutants emitted plus $56 per ton of Criteria Air Pollutants emitted. For Class II facilities, fees will be the sum of $80 per ton of Hazardous Air Pollutants emitted plus $56 per ton of Criteria Air Pollutants emitted.
A few important announcements regarding your current 2023 annual emissions inventory submittal:
- Design capacity of all combustion-related emission units must be included; This is found in the ‘Emission Unit’ portion of SLEIS. Staff will be verifying this is included in your report and will request design capacity prior to your report being approved.
- All facilities which are required to apply for an operating permit, regardless of operating status, must submit an annual inventory.
- Annual emissions inventories are submitted electronically using SLEIS, https://kdhe.windsorcloud.com/sleis/ · Fees can be paid electronically utilizing KEIMS (https://keims.kdhe.ks.gov/) or they can be paid by check via mail. Please note that any mailed submission requirements (i.e., fee check) must be postmarked on or before the deadline date (April 1, 2024) or your facility may be subject to late fees as dictated by regulations.
- The late fee per regulation is $200 per calendar day; This late fee will be enforced!

- All emissions of Criteria Air Pollutants (CAPs) must be reported, and all Hazardous Air Pollutants (HAPs) with facility-wide emissions greater than 20 pounds must be reported. CAPs include Particulate Matter (PM10-Filterable, PM2.5-Filterable, and PM-Condensable), Sulfur Dioxide (SO2), Oxides of Nitrogen (NOx), Volatile Organic Compounds (VOC), Lead (Pb), Carbon Monoxide (CO), and Ammonia (NH3).
