Kent County Concludes Agreement with Anaergia
Today, the Kent County Board of Commissioners voted to conclude its agreement with Anaergia, the company originally selected as the anchor tenant for the Department of Public Works’ (DPW) Sustainable Business Park. The decision reflects a number of contributing factors, including shifts in economic conditions and leadership changes within Anaergia.
To avoid the uncertainty and cost of a potentially lengthy legal process, the Board approved a $725,000 settlement, which will be paid by the County’s insurer. The settlement includes no admission of liability by either party.
With this matter resolved, the DPW remains committed to advancing the Sustainable Business Park and its long-term goal of diverting 90% of waste from landfills. On Feb. 6, 2025, the Board of Public Works approved the completion of final infrastructure design and bid documents for the project.
The Sustainable Business Park is planned to include facilities for mixed waste processing, organics recovery, stormwater management, research and development, construction and demolition debris sorting, and end-use operations. A new South Kent Transfer Station is also in design, with construction anticipated to begin in 2027.
Construction of the broader business park is expected to begin in 2026, pending approval by the Board of Commissioners.
