Governor Whitmer Signs House Bill 4920, Establishing New District Judge for Kent County
GRAND RAPIDS, Mich. (December 19, 2023) – Governor Gretchen Whitmer recently signed House Bill 4920 into law, paving the way for the establishment of a new district court judge in Kent County. Introduced by Representative John Fitzgerald, this legislation marks a significant move aimed at enhancing judicial efficacy within the county.
“Kent County residents deserve prompt judicial proceedings, and we’ve helped ensure that today. Allowing for an additional judge in the 63rd District Court will help those in need receive the justice they deserve in a timely manner,” said state Rep. John Fitzgerald (D-Wyoming). "This bill will have a lasting, positive impact on the lives of Kent County residents, especially as we continue to see our county grow and be a desirable location in Michigan."
The need for this judgeship is evident when considering the data. Over a five-year period (2016-2020), the 63rd District Court saw an average of 26,541 new case filings. This figure equates to approximately 13,271 cases per judge, surpassing caseloads observed in other district courts across Kent County and the State of Michigan.
“Our docket is facing significant strain,” said Chief Judge Jeffrey J. O’Hara. “The addition of a new judge to the bench reflects our commitment to delivering a justice system that residents expect and deserve. This crucial step will ensure that cases are handled more efficiently and with the timeliness our community rightfully demands."
In October, the Kent County Board of Commissioners approved a new district judge position, as required by this legislation.
“Rep. Fitzgerald's recognition of the pressing need for this bill and his leadership in guiding it through the Legislature is greatly appreciated," said Kent County Administrator Al Vanderberg. "Our current judiciary staff has shown immense dedication, yet the strain caused by the high caseloads was simply unsustainable. The addition of a district judge will offer crucial support to our district court to more effectively manage the caseloads."
The process of establishing judgeships generally follows a structured path. Initially, the State Court Administrators’ Office (SCAO) conducts a review of population trends and court caseloads. Using this analysis, the SCAO recommends the addition or elimination of judgeships. Subsequently, the SCAO’s recommendations require legislative approval. The local governing board, such as the Kent County Board of Commissioners, must also approve any judicial changes.
The new district judge will be chosen by election, with the filing deadline on April 23, 2024 and the primary election on August 6, 2024. The general election is on November 5, 2024.
