We Remember Laura Lynne Kopetsky 1961 - 2019
A longtime DBE Laura Lynne Kopetsky age 58, went from Labor to Reward on July 4, 2019. Laura came into this world with a bang on February 23, 1961. Laura started Laura Kopetsky Tri-Ax, Inc. with a single truck and a load of determination 39 years ago. Her company evolved into one of the most well-known businesses on the southside of Indianapolis and one of the largest woman-owned dump truck companies in the state of Indiana. The DBE Community will miss Laura.

Shrewsberry Receives Whistler Award

The Greater Indianapolis Progress Committee (GIPC) and Mayor Joe Hogsett have named Bill Shrewsberry the winner of the 2019 Charles L. Whistler Award. The annual award recognizes individuals who, outside the regular duties of their chosen professions, have brought together the public and private sectors for civic improvement in Indianapolis. Shrewsberry founded Shrewsberry & Associates in 2001 and served as president for 17 years. He previously retired from Indiana Bell/Ameritech after 27 years in management.

Changes are coming to our DBE Application
Earlier this year USDOT issued changes to the uniform application that impact ACDBEs and those pursuing interstate certification. We are integrating those changes into our electronic application and we’ve developed a simpler form for those out of state seeking certification in Indiana. Look for the final products launching later this year.

Have you ever wondered what INDOT has paid the prime contractor for your work? How about records for a specific item? INDOT Technical Application Pathway (ITAP) is your source to those answers. If you do not have an ITAP account, you can sign up at https://itap.indot.in.gov/. If you already have an ITAP account, you can request the SMGR Report application. Once you have access to the SMGR Report application, you simply enter your INDOT contract number, which gives you access to several reports. Below is a screenshot from the SMGR Report in ITAP. How is DBE Participation Counted Toward Goals?
This article will provide the contracting community and Disadvantaged Business Enterprises (“DBE”) with an overview of the evaluation of commercially useful functions on contracts and how and when DBE participation is counted toward contract goals. Finally, real-world examples will be provided that have resulted in DBE participation being reduced or discounted altogether.
To begin with, the DBE rules and regulations apply to INDOT contracts that are funded in whole or in part with USDOT financial assistance. Under these rules and regulations (49 CFR Part 26), DBE participation may only be counted when a DBE is performing a Commercially Useful Function (“CUF”). A DBE performs a CUF when it is responsible for execution of the work of the contract and is carrying out its responsibilities by actually performing, managing, and supervising the work involved. Bulletin Board Compliance
What is one thing that every federally funded contract at INDOT has in common with one another?
All federally funded contracts have to have a bulletin board placed on the worksite that contains valuable contract information, laws, and policies!
This bulletin board must be easily accessible and located where workers gather daily. It must be up and in working order BEFORE the first day of work! All posters must be spread and visible on the bulletin board. The board must be waterproof, and posters should remain legible throughout the entire duration of the contract. If working in an area with a high Spanish-speaking demographic, the prime contractor should place the English and Spanish versions on the bulletin board. Prompt Payment
Per federal regulations and INDOT contract specifications, prime contractors must pay all subcontractors — including lessors and materials suppliers — within 10 business days after being paid by the Department. Prompt and full payment of any retainage held by prime contractors must be paid to subcontractors within 30 calendar days after satisfactory completion of their work. Satisfactory completion shall be interpreted as when the subcontractor has completed all physical work, and completed other contract requirements including the submission of all submittals required by the Department. New OJT Program Requirement for INDOT Prime Contractors
Beginning with the January 2019 enrollment process, INDOT will require all OJT program participants to submit an executed copy of their United States Department of Labor (USDOL) or Federal Highway (FHWA) approved OJT training program concurrent with their OJT partnership agreement. The submission of this document will assist INDOT by providing evidence that the trainee hours claimed are part of an approved program and decrease the potential for misrepresentation or fraud in the OJT program. DBE’s please continue to use the opportunity for additional work through the Indiana/Kentucky DBE Exchange. The attached marketing flyer has gone out to all prime contractors in Indiana and Kentucky. DBE’s certified in Indiana can work on Kentucky projects as DBE’s without seeking DBE certification with this agreement through June 30, 2023. Indiana Constructors, Inc. (ICI), the state’s highway, heavy and utility construction trade association, is offering a special membership incentive for all certified INDOT DBEs. DBEs may join at half the regular member rate. The second-year rates increase by 25 percent, and during the third year, the organization asks DBEs to pay the full membership rate. These rates vary by business type.
